15.32.010 - Code adopted.

The Uniform Swimming Pool, Spa and Hot Tub Code, 1991 Edition, is adopted. That certain document entitled "Uniform Swimming Pool, Spa and Hot Tub Code, 1991 Edition," published by the International Association of Plumbing and Mechanical Officials is adopted by reference, together with all indexes and appendixes thereof and therefor, except as hereinafter amended in this chapter. This chapter shall be known and referred to as the "Swimming Pool, Spa and Hot Tub Code" of and for the city.

15.32.020 - Plans to be submitted.

All plans hereafter submitted to the city for swimming pools to be constructed shall show compliance with the code adopted in Section 15.32.010 and final inspection and approval of all pools hereinafter constructed shall be withheld until all requirements of the code adopted in Section 15.32.010 have been complied with.

15.32.030 - Exceptions.

The provisions of the code adopted in Section 15.32.010 shall not apply to public swimming pools for which a charge or admission price is required to be paid for such use thereof, nor to swimming pools which are a part of and located upon the same premises as a hotel or motel, during the time that the owner, operator or adult employee of such owner or operator is present at and in active charge of the premises upon which such pool is located.

15.32.040 - Amendment—Section 1.11.

Section 1.11 of the Uniform Swimming Pool, Spa and Hot Tub Code is amended as follows:

Every applicant for a permit to install, alter, or repair a swimming pool, spa or hot tub system or part thereof, shall state in writing on the application form provided for that purpose, the character of work proposed to be done and the amount and kind in connection therewith, together with such information pertinent thereto as may be required.

Such applicant shall pay for each permit at the time of making application, a fee in accordance with a scheduled adopted by resolution of the City Council of the City of Sierra Madre.

Any person who shall commence any swimming pool, spa, or hot tub work for which a permit is required by this Code without having obtained a permit therefor shall, if subsequently permitted to obtain a permit, pay double the permit fee fixed by the section for such work, provided, however, that this provision shall not apply to emergency work when it shall be demonstrated to the satisfaction of the City that such work was urgently necessary and that it was not practical to obtain a permit therefor, before the commencement of the work. In all such cases a permit must be obtained as soon as it is practical to do so, and if there be an unreasonable delay in obtaining such permit, a double fee as herein provided shall be charged.

When extra inspections are necessary by reason of deficient or defective work, or otherwise through fault or error on the part of the holder of the permit or on the part of his employees, only one such extra inspection shall be made under the regular fees as herein prescribed; and for each and every further extra visit or inspection for which the holder of the permit or his/her employee is entirely responsible for an additional fee as established by resolution of the City Council of the City of Sierra Madre.

Whenever it shall be necessary to make an additional inspection due to the failure or neglect of the applicant to give the correct address or location of the work specified in the permit when applying therefor, for each additional inspection an additional fee will be assessed in accordance with a schedule established by resolution of the City Council of the City of Sierra Madre.
