13.16.630 - Violation—Penalties.

A. Every person violating any provision of this chapter, (except for the industrial wastewater pretreatment ordinance), including the failure to pay any fees, charges or surcharges imposed hereby, or any condition or limitation of a permit or plan approval issued pursuant thereto, is guilty of an infraction, and upon conviction is punishable by a fine not to exceed five hundred dollars ($500.00).

B. Each day during which any violation continues shall constitute a separate offense punishable as provided above.

C. The city may sue to recover any amounts due the city under the provisions of this chapter.

D. In the event of such violation, the city shall petition the superior court to impose, assess and recover such sums.

13.16.640 - Abatement of violations—Required.

A. The owner(s) of property(ies) violating any provision(s) of this chapter shall immediately cause such violation(s) to cease.

B. Any construction, reconstruction or repair of facilities required to eliminate such violation(s) shall be completed within sixty (60) calendar days of written notice that such violation(s) exists. These sixty (60) calendar days may be extended with the number of days of inclement weather experienced since the beginning of such sixty (60) day period which shall be three days following the day that the city mails such written notice, first class mail, at the Central Valley, California, post office.

13.16.650 - Abatement of violations—Procedure.

Abatement procedure is as follows:

A. Identify violations of this chapter;

B. Provide written notification of such violations;

C. Meet with owners of property, or their representatives, on the site, one time, to discuss the exact locations of the observed violations. On the site, issue a permit for the necessary construction, reconstruction or repair. There will be no charge for a permit for repair of facilities previously accepted by the city that are the subject of the written notice of violations;

D. Inspect the completed construction, reconstruction or repair. Re-smoke-test the repairs as schedule permits. Make any requested or additional site visits or reinspections. May levy nominal fee for required reinspections beyond initial two reinspections.

13.16.660 - Failure to cease violations—Sanctions.

Failure to cease such violation(s) shall cause the city to proceed with any or all sanctions described in other sections of this chapter.
