1.16.010 - Penalty.¶
A. It is unlawful for any person to violate any provision or fail to comply with any requirement of this code. Any person violating any of the provisions or failing to comply with any of the mandatory requirements of this code is guilty of a misdemeanor, unless the events are specifically classified in this code or by state law as an infraction, or the charge is reduced to an infraction, in which case the person shall be guilty of an infraction.
B. Any person convicted of a misdemeanor for violation of an ordinance of the city is punishable by penalty of not more than one thousand dollars ($1,000.00) or by imprisonment in county jail for a period not to exceed six months, or by both such fine and imprisonment.
C. Any person convicted of an infraction of the provisions of this code, unless provision is otherwise made in this code, shall be punishable upon first conviction by a fine of not more than one hundred dollars ($100.00), and for a second conviction within a period of one year by a fine of not more than two hundred dollars ($200.00) and for a third or any subsequent conviction within a period of one year by a fine of not more than five hundred dollars ($500.00).
D. Each person shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of the ordinances of the city is committed, continued or permitted by any such person, and he or she shall be punishable accordingly.
