8.02.010 - Recognition and purpose.

There is in Shasta County government a department of resource management which is intended to be a comprehensive environmental agency of Shasta County, within the meaning of section 101275 of the Health and Safety Code, as now enacted and as may hereafter be amended. The total function of providing environmental health and sanitation services and programs that would otherwise be the responsibility of the health officer is transferred to the department of resource management.

8.02.020 - Department structure.

The department of resource management shall be comprised of the following divisions: environmental health, administration/community education, building and safety, planning, and other such divisions as may be established from time to time by the board of supervisors by resolution. The air pollution control board of the Shasta County air quality management district may appoint the director of resource management to serve as the air pollution control officer as provided in Sections 40750 and following of the Health and Safety Code, as now enacted and as may hereafter be amended. In that event, the department of resource management shall also consist of an air quality management division.

8.02.030 - Powers, duties, and operation.

A. The department of resource management shall be responsible to the board of supervisors, through the county executive officer and shall, to the extent not limited by law, provide all environmental health and sanitation services; administer the state Planning and Zoning Law, the Subdivision Map Act, and the California Environmental Quality Act, as provided by the board of supervisors in the land use regulation and zoning provisions of this code and related board resolutions; provide staff support to the Shasta County planning agency as defined in Section 2.48.010 of this code; administer the provisions in this code for building regulations, overhead utilities, swimming pool safety, well construction and storage of hazardous substances and shall be designated and charged as the department responsible for the duties stated in Health and Safety Code section 17964, as now enacted and as may hereafter be amended, except as otherwise set forth in this code and in statutes; and administer the programs and other related resource and environmental management functions that the board of supervisors may delegate to the department. Any reference in this code to "department of community development," "department of development services" or the "planning department" shall be construed as a reference to the department of resource management. Any reference to "planning director," "director of community development" or "director of development services" shall be construed as a reference to the director of resource management except as otherwise provided in this chapter.

B. The department of resource management shall be operated and managed in ways consistent with the requirements of Subchapter 2 (commencing with section 1351) of Chapter 3 of Title 17 of the California Code of Regulations and other applicable statutes and regulations.

C. The air quality management division of the department of resource management shall be responsible to the air pollution control board of the Shasta County air quality management district through the director of resource management serving as the air pollution control officer.

8.02.040 - Director—Appointment—Duties.

A. The director of resource management shall be appointed by the board of supervisors upon the recommendation of the county executive officer, and shall report to the board through the county executive officer. The director of resource management shall serve at the pleasure of the board of supervisors. The director of resource management shall be responsible for the overall supervision and oversight of the department of resource management except as otherwise provided by law.

B. The director of resource management shall serve as the county's building official, as defined by Health and Safety Code section 18949.27, as now enacted and as may hereafter be amended, if he or she (1) possesses a current International Codes Council (ICC) building official certificate, and (2) has at least one year of experience in the administration, interpretation, and enforcement of building codes. In addition, possession of a current ICC building inspector or plans examiner certificate is preferred, but not required. If the director of resource management does not meet such qualifications, he or she shall designate a management employee in the department of resource management who meets such qualifications to serve as the county's building official. A management employee so designated by the director of resource management shall serve in the capacity of building official at the pleasure of the director of resource management.

C. (1)

If the director of resource management is registered as an environmental health specialist pursuant to Article 1 (commencing with section 106600) of Chapter 4 of Part 1 of Division 104 of the Health and Safety Code, as now enacted and as may hereafter be amended, and qualified under section 1355 of Title 17 of the California Code of Regulations, as now enacted and as may hereafter be amended, the director of resource management shall serve as the director of environmental health, and shall be responsible for the administration of environmental health and sanitation services and programs.

(2) If the director of resource management does not satisfy the aforementioned qualifications, the board of supervisors shall appoint a separate director of environmental health who satisfies the qualifications, upon the recommendation of the director of resource management, and who shall report to the board of supervisors through the director of resource management. The person so appointed shall serve in the capacity of director of environmental health at the pleasure of the board of supervisors. Except as specifically provided in section 8.02.040 (C)(2) of this Code, the director of resource management shall be the appointing authority for all employees in the department of resource management. The separate director of environmental health shall be responsible for the administration of environmental health and sanitation services and programs.

(3) The director of environmental health shall possess all powers and exercise all duties relating to environmental health and sanitation services and programs, except to the extent that any service or program is wholly within such jurisdiction as may be retained by the health officer over any such service or program. The director of environmental health shall communicate directly with the health officer whenever necessary to assure coordination of public health programs and environmental health and sanitation services and programs.

D. If the director of resource management is appointed to be the air pollution control officer by the air pollution control board of the Shasta County air quality management district, he or she shall be responsible for the supervision and oversight of the air quality management division of the department of resource management. The director of resource management shall serve in the capacity of air pollution control officer at the pleasure of the air pollution control board of the Shasta County air quality management district.

8.02.050 - Health officer—Authority.

A. The health officer shall delegate to the director of environmental health those powers, functions, duties and responsibilities regarding environmentally based public health programs as are identified in the state department of health services bulletin titled "Services in a Local Environmental Health and Sanitation Project," September 1976, and as it may hereafter be amended.

B. Nothing in this chapter shall he deemed or construed to diminish in any way the jurisdiction over health emergencies retained by the health officer, pursuant to section 101310 of the Health and Safety Code, as now enacted and as may hereafter be amended.
