8.48.010 - Purpose.

The purpose of this chapter is to prevent the accidental drowning of those who by reason of age or disability require supervision near swimming pools.

8.48.020 - Definitions.

The following words have the meanings indicated unless the context in which any word is used requires another meaning:

"Person" means a natural person, his heirs, executors, administrators or assigns, or any firm, partnership, corporation or the successors. assigns or agents of any of them.

"Swimming pool" means a receptacle for water capable of containing water at a depth of more than two feet, or an artificial pool of water with a depth of more than two feet at any point, intended for the purpose of immersion or partial immersion of human beings and includes all appurtenant equipment.

8.48.030 - Public swimming pools—Permit required.

A. No person shall operate or maintain any public swimming pool in the county unless a valid, unrevoked swimming pool permit issued by the health officer is in effect for the pool.

B. The health officer shall issue a permit annually for a public swimming pool if all of the following conditions are first met:

  1. The person requiring the health permit has applied for it on a form provided by the health officer;

  2. The current annual inspection fee has been paid;

  3. All applicable federal and state statutes and local ordinances have been complied with or work to obtain such compliance is progressing at a rate satisfactory to the health officer.

C. For purposes of this section, "public swimming pool" means and includes all pools subject to the provisions of Chapter 1 (commencing with section 24100) of Division 20 of the Health and Safety Code and Chapter 20 (commencing with section 65501) of Title 22 of the California Administrative Code.

8.48.040 - Fencing required.

No person who owns or is in possession of any real property shall cause or permit an outdoor swimming pool to exist on that property unless and until the area proposed for the swimming pool is first enclosed and surrounded by a fence or wall at least five feet high. Chain link fencing or vertical slat fencing with maximum slat spacing of four inches or masonry meet the requirements of this section. The building official may approve other materials or enclosing structures which in his opinion will prevent intrusion upon a swimming pool; provided, that no opening in these materials or structures, other than openings for doors or gates, allows a sphere four inches in diameter to pass through it.

8.48.050 - Requirements for doors and gates.

Every door or gate in any enclosing structure required by Section 8.48.030 shall completely fill any opening in the enclosing structure provided for the door or gate. Every door or gate shall be equipped with self-closing and self-latching devices on the interior side of the enclosing structure that are capable of keeping the door or gate securely closed and are located not less than four feet above ground level. Locks may be used in lieu of these self-closing and self-latching devices; provided, doors and gates equipped with locks are locked shut at all times when the swimming pool is not in actual use. The provisions of this section do not apply to any exterior wall of a building or mobile home when that wall is a segment of the enclosing structure required by Section 8.48.030.
