6-24-1: PURPOSE:¶
The purpose of this chapter is to provide minimum standards to safeguard the life, health, property, and public welfare in keeping with the character of the city by establishing standards to control exposure of minors to tobacco products and to regulate the manner in which tobacco products are sold. 6-24-2: DEFINITIONS:¶
For the purposes of this chapter, words and phrases shall be given their customary and usual meanings and shall be interpreted and construed accordingly, unless a different meaning is expressly ascribed thereto.
| E-CIGARETTE OR VAPOR CIGARETTE: | Battery powered devices that convert liquid nicotine and/ |

| ELECTRONIC SMOKING DEVICE: | Any such device, whether manufactured, distributed, marketed, or sold as an electronic cigarette, an electronic cigar, an electronic cigarillo, an electronic pipe, an electronic hookah, or any other product name or descriptor. |
| EMPLOYEE: | Any person in the service of another under any contract of hire, express or implied, oral or written, where the employer has the power or right to control and direct the employee in the material details of how the work is to be performed. Employee also includes any person volunteering his or her time or service. |
| MINOR: | Any person under eighteen (18) years of age. |
| TOBACCO PARAPHERNALIA: | Any item designed or marketed for the consumption, use, or preparation of Tobacco Products. |
| TOBACCO PRODUCT: | (A) Any product containing, made, or derived from tobacco or nicotine that is intended for human consumption, whether smoked, heated, chewed, absorbed, dissolved, inhaled, snorted, sniffed, or ingested by any other means, including, but not limited to cigarettes, cigars, little cigars, chewing tobacco, pipe tobacco, snuff; or (B) Any electronic device that delivers nicotine or other substances to the person inhaling from the device, including, but not limited to an electronic cigarette, electronic cigar, electronic pipe, or electronic hookah. (C) Notwithstanding any provision of subsections (A) and (B) to the contrary, "Tobacco Product" includes any component, part, or accessory intended or reasonably expected to be used with a Tobacco Product, whether or not sold separately. "Tobacco Product" does not include any product that has been approved by the United States Food and Drug Administration for sale as a tobacco cessation product or for other therapeutic purposes where such product is marketed and sold solely for such an approved purpose. |
| TOBACCO STORE OR TOBACCO SHOP: | A retail or wholesale business or any person that sells, offers for sale or offers to exchange for any form of consideration, tobacco, tobacco products, or tobacco paraphernalia and has fifteen percent (15%) or more of its square feet in the establishment used for the sale or display of tobacco, tobacco products or tobacco paraphernalia. |
| VENDOR ASSIST: | Only store employees have access to the tobacco product and assist a customer by supplying the product. The customer does not take possession of the product until it is purchased. (Ord. 2013-11, 12-2-2013; amd. Ord. 2022-1, 3-21-2022) |
6-24-3: CIGARETTES OR TOBACCO, SALE OF TO MINORS:¶
It shall be unlawful for any person to sell or give away, directly or indirectly, to any person under the age of eighteen (18) years any cigarettes, tobacco or any compounds of tobacco used in filling up or making up of a cigarette or to give or sell any cigarette papers to minors. 6-24-4: E-CIGARETTES, SALES TO MINORS:¶
It shall be unlawful for any person to sell or give away, directly or indirectly, to any person under the age of eighteen (18) years any e-cigarette or any compound used to consume vapor from e-cigarettes. (Ord. 2013-11, 12-2-2013)
6-24-5: USE OF ELECTRONIC OR VAPOR CIGARETTES PROHIBITED:¶
It shall be unlawful for any person to use e-cigarettes or vapor cigarettes anywhere in the city where the use of tobacco is prohibited. (Ord. 2013-11, 12-2-2013)
