12.36.010 Purpose.

It shall be unlawful for any person, firm or corporation to set out for exhibition, show, or otherwise, or to maintain or allow any goods, wares, or merchandise, or advertising matter upon any sidewalk or curb in the City of Sebastopol, between the outer edge of the sidewalk or curb and the property line; and no goods, wares, merchandise, or other thing of any nature shall be, by any person, firm, or corporation, placed or allowed to remain on any sidewalk or curb within the City of Sebastopol between the outer edge of the sidewalk or curb and the property line where such goods, wares and merchandise or other things of any kind and nature are placed, or allowed to remain except as provided in this chapter.

12.36.020 Loading and unloading goods, wares or merchandise.

Nothing herein contained shall prohibit the right of any person, firm, or corporation to load or unload any goods, wares, or merchandise in front of the place of business of such business, firm, or corporation, and leave such goods, wares, and merchandise upon said sidewalk or curb for such length of time as is reasonably necessary for the purpose of loading or unloading the same.

12.36.030 Revocable permit.

The City Council may, by motion, grant a revocable permit for the use of the sidewalks in the City of Sebastopol. Except as may be modified by the motion approving the permit, the use of the sidewalks shall not exceed one-third of the distance between the outer edge of the sidewalk or curb and the property or building line. In no event shall such use interfere with or obstruct the reasonable use of said sidewalk by pedestrian traffic. Prior to the issuance of such permit the property owner or applicant shall provide the City with evidence that the City is a named insured for public liability and property damage in an amount to be determined by the City Manager. Upon the adoption of such motion and written evidence of such insurance the City Manager shall issue the necessary permit.

12.36.040 Violation of chapter.

Any goods, wares, merchandise, substance or other object or thing which is placed, deposited or located on the sidewalk as provided herein in violation of any of the sections of this chapter, or which are maintained thereon after a permit has been revoked or in violation of the conditions of the permit, is hereby declared to be a public nuisance; and it shall be the duty of the Building Inspector, Superintendent of Streets, and of any other public officers to summarily remove and abate the same; and the person or persons responsible therefor shall be liable to the City for the reasonable cost of such abatement in addition to all the other penalties provided by law.
