5.26.090 - Alarm business—City business license required.

It is unlawful for any person who owns or operates an alarm business to conduct, cause, or permit to be conducted an alarm business within the city without a valid city business license issued for the conduct of such business. Such license shall be in addition to the State Department of Consumer Affairs license which such person shall acquire under state laws.

5.26.100 - Conditions.

Each alarm business licensee shall comply with the following conditions:

A. Each license shall provide the chief of police with the address of each building, place, or premises, for which the licensee sells or installs an alarm system.

B. Audible alarm systems serviced or maintained on or in any building, place, or premises by a licensee shall have the name and emergency telephone number of the licensee's alarm business posted on or near the front door of such building, place, or premises. Upon notification by the police department that an audible alarm is activated, the licensee or the licensee's alarm agent shall immediately proceed to silence the alarm.

C. Each licensee who installs or services an alarm system subject to the conditions set forth in this section shall clearly instruct the subscriber in the proper use and operation of the alarm system, especially in those factors which can cause false alarms.

D. Each licensee who services an alarm system subject to the conditions set forth in this section shall respond to service each alarm within forty-eight hours after the licensee has been notified by the subscriber or the police department that an alarm system has malfunctioned.

E. Each licensee shall display to the chief of police, upon request, the licensee's records of inspections and repairs of any alarm system subject to the conditions set forth in this section.

F. Each licensee shall notify, in person, the police department's communications center whenever an alarm system is under service or repair so as to cause a police response.

G. Each alarm system sold, leased, maintained, serviced, or installed by a licensee that operates on commercial current shall be equipped with a standby power supply sufficient for at least four hours.

5.26.110 - Administrative regulations—Adoption and approval.

In order to carry out the provisions and purposes of this chapter, the chief of police, from time to time, may implement such provisions by adopting and enforcing administrative regulations concerning the safety and security of alarm systems, the installation of alarm equipment, and the keeping of records concerning alarm systems. The administrative regulations adopted by the chief of police, and amendments thereto, shall not become effective until they have been ratified by resolution of the council.

5.26.120 - Alarm monitoring systems terminating at the police department prohibited.

A. The installation of any alarm monitoring system in a manner which, when the system is activated, would cause a signal or message to be sent directly to the police department by a telephone line or by any other means shall be prohibited.

B. It is unlawful to install any system prohibited by subsection A of this section.

5.26.130 - Restrictions.

A. No person, except a public utility engaged in the business of providing communications, services, and facilities, shall use or operate, attempt to use or operate, cause to be used or operated, or arrange, adjust, program, or otherwise provide or install any device or combination of devices which, upon activation, either mechanically, electronically, or by other automatic means, will initiate an intrastate call and deliver a recorded message to any telephone number used for the receipt of emergency or governmental administrative messages by the police department or any administrative office or department of the city.

B. For the purposes of this section, "telephone number" means and includes any additional numbers associated with such emergency or governmental administrative telephone number through the use of a rotary or other system whereby additional telephone calls to the number are connected to other numbers when the first number is in use.

C. No alarm shall be used to summon help for any other cause than that for which it was installed.
