Sec. 58-51. - Penalty for violation of article.¶
Any person violating any provision of this article shall be deemed guilty of an infraction and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this article is committed, continued or permitted, and upon conviction of any such violation, such person shall be punished in accordance with section 1-7.

Sec. 58-52. - Required.¶
No person shall encroach upon any public right-of-way of the city unless and until such person first obtains and keeps in force and effect a valid encroachment permit issued pursuant to the terms of this article.

Sec. 58-53. - Issuance by director of development services.¶
The director of development services shall issue a temporary permit to encroach upon the public right-of-way of the city only if an applicant for such a permit meets the burden of providing that:
(1) Issuance of an encroachment permit will meet an urgent, temporary need to accomplish the applicant's legitimate purpose and that such legitimate purpose cannot be feasibly accomplished by any means other than through the issuance of a permit.
(2) The issuance of a permit will not be detrimental to the public health, safety and welfare.
(3) The applicant shall comply with, or be capable of complying with, all the terms, conditions and restrictions that are incorporated in the permit.

Sec. 58-54. - Covenant agreement may be required.¶
If, in the discretion of the director of development services, the proposed encroachment appears to be of sufficient duration, a covenant agreement may be required as a condition of the encroachment permit. The director of development services is hereby authorized to sign such covenant agreement on behalf of the city for the purpose of recording such document.

Sec. 58-55. - Fee.¶
Fees relating to the issuance of an encroachment permit, covenant or inspection shall be charged in accordance with a resolution adopted by the city council.

Sec. 58-56. - Revocation.¶
The director of development services shall revoke any encroachment permit upon determining that the permittee has failed to comply with one or more of the terms, conditions or restrictions incorporated in the permit. Upon the revocation of any encroachment permit, the permittee shall immediately cease and desist from encroaching on the public right-of-way of the city.
