Sec. 38-141. - Loitering about school grounds, churches, theaters and public places.

(a) It shall be a misdemeanor for any person, not a student of the school involved, to return to any school grounds, school buildings or streets, sidewalks or public ways adjacent thereto, without lawful business therein, within a period of 90 days if the person has been asked during school hours or during school functions to leave the school grounds, school buildings or streets, sidewalks or public ways adjacent thereto, by the chief administrative officer of such school, by any certified employee designated as an agent of the chief administrative officer or by any peace officer for any of the reasons set out in paragraph (c).

(b) It shall be a misdemeanor for any person to: (a) loiter in or at the entrance of or approach to any church, hall, theater, public place, or public assemblage; (b) to stand or sit in or at the entrance of or approach to any church, hall, theater, public place, or public assemblage so as in any manner to obstruct the entrance or approach thereto; or (c) to return to any church, hall, theater, public place, or public assemblage within a period of 90 days after being asked by any peace officer to leave such premises for any of the reasons set out in paragraph (c). As used in this section, "loiter" means to delay, to linger, or to idle about without lawful business for being present.

(c) (1)

Misconduct on or about any of the above described premises, misconduct being defined by local school regulations relating to paragraph (a) and/or by Penal Code § 415.

(2) Conviction of an offense requiring registration under Penal Code § 290.

(3) Conviction of any offense included in Health and Safety Code § 11000 et seq. or Health and Safety Code § 11530 et seq.

(4) Repeated and/or frequent loitering in or about the above premises, without a lawful business purpose at such premises.

(d) Penalties, minors; cost recovery. Any person who violates a provision of this section shall be subject to the penalties set forth in section 1-7 of the Sanger City Code. Minors shall be dealt with in accordance with California Welfare and Institutions Code and in accordance with any policies and procedures established by the city for handling juvenile cases. The city may recover its actual costs of administration and transportation services in connection with returning the minor to his or her place of residence, or to the custody of his or her parents or legal guardians, in accordance with California Welfare and Institutions Code § 625.5.
