§ 2.4.100. PERMIT REQUIRED.¶
All persons who engage in professional filming within the City of San Leandro shall be required to obtain a permit, except where the professional filming involved is for news gathering purposes.
§ 2.4.200. APPLICATION.¶
All persons seeking a permit for professional filming must submit an application to the Film Liaison on the forms provided by the City.
§ 2.4.300. FEES.¶
Unless exempt pursuant to §2.4.400, all persons shall pay a non-refundable application fee. The amount of this application fee shall be as set forth in San Leandro Administrative Code. All applicants granted a permit shall also pay a permit fee as set forth in the San Leandro Administrative Code prior to issuance of the permit.
§ 2.4.400. FEE EXEMPTIONS.¶
The following persons are exempt from the application fee requirement in §2.4.300: bona fide students, nonprofit corporations, and persons engaging in public service filming. Notwithstanding this Section, all persons exempt from the application fee are required to obtain a permit and to pay any and all other required fees, rates or charges.
§ 2.4.500. WRITTEN PERMISSION REQUIRED.¶
Prior to commencement of professional filming, all permittees are required to obtain and submit to the City evidence of written permission to enter the property from all property owners and tenants of those properties surrounding the location that will be directly affected by the professional filming.
§ 2.4.600. WRITTEN NOTICE REQUIRED.¶
Not less than 72 hours prior to commencement of professional filming, all permittees shall provide written notice to all property owners or tenants within a 300-foot radius of the professional filming location.
§ 2.4.700. PROFESSIONAL FILMING HOURS.¶
Professional filming shall not be permitted between the hours of 7:00 p.m. and 7:00 a.m. except as specifically allowed by the Film Liaison.
§ 2.4.800. INSURANCE REQUIREMENTS.¶
All permittees shall have insurance coverage of the type and in the amounts specified by the Film Liaison. Evidence of compliance must be submitted to the Film Liaison prior to professional filming. Each permittee shall hold harmless, defend and indemnify the City, its elected officials, officers, and employees from and against any or all loss, liability, expense, claim, costs (including costs of defense), suits and damages of every kind, nature and description from the negligence of the permittee or its agents.
§ 2.4.900. FILM LIAISON.¶
The Film Liaison is authorized to promulgate any additional regulations necessary to effectuate the provisions of this Title. The Film Liaison shall act with reasonable dispatch and diligence in administering these regulations.
§ 2.4.905. BUSINESS LICENSE EXEMPTIONS.¶
A business license shall not be required for filming projects lasting three days or less and involving a total of three or fewer cast and crew members. The Finance Director shall have the discretion to require a business license for any project scheduled to last more than three days and involving more than three cast and crew members.
