10-4400 - FRANCHISE REQUIRED.

Any person or corporation, except those granted special privileges by law of the State of California, desiring to make use of any county street or county highway within the County for the purpose of erecting or installing therein or thereon any facility shall be required to obtain from said county a franchise authorizing such use. Each such person or corporation shall make application to the Board of Supervisors of said county for the privilege or franchise he desires to exercise or enjoy.

10-4401 - GRANTING FRANCHISE.

Every franchise or privilege whatsoever hereafter proposed to be granted by the Board shall be granted subject to the laws regulating the activity of the applicant therefor and the laws granting the franchise or privileges by the Board, and the grantee of any such franchise or privilege shall have the right as against all persons to make use of the county streets and county highways as provided in the franchise or privilege granted by the Board to the full extent of the lawful authority of the County to permit such use.

10-4402 - LEAD AGENCY; ADVISORY CAPACITY.

The Environmental Health Division of the Public Health Service is designated as the lead agency for the assessment of abandonment or removal of underground pipelines which transport hazardous materials pursuant of County-granted franchises for the use of County rights-of-way. The Environmental Health Division will also participate in an advisory capacity concerning the grant of any franchise under this chapter, to provide information concerning hazardous materials, potential for environmental harm if a franchise is granted, and the scope of work and resources required to alleviate any environmental hazard if the hazardous material is released into the ground or atmosphere of San Joaquin County.
