Sec. 78-101. - Filing of map prerequisite to request for waiver.¶
A subdivision tentative parcel map must be filed with the planning department prior to initiating a request for a waiver of the parcel map requirement.

Sec. 78-102. - Form, contents of request.¶
A request for a waiver made under this division shall be made in writing and shall be signed by all the owners of record of the proposed subdivision. The request shall describe the subdivision and each proposed parcel and shall identify the tentative parcel map of the subdivision which has already been filed with the planning department and engineering department. The subdivider shall supply additional information when deemed necessary by the planning director or city engineer.

Sec. 78-103. - Subdivider's compliance with conditions of approval.¶
A waiver request shall not be approved pursuant to this division unless the subdivider completes or agrees to comply with any conditions of approval as if a parcel map were to be filed.

Sec. 78-104. - Approval procedure.¶
A waiver request made pursuant to this division shall not be approved unless:
(1) The planning director and city engineer approve or conditionally approve the tentative parcel map.
(2) The planning director and city engineer find that the description of the subdivision in the waiver request conforms to the approved tentative parcel map.
(3) The planning director and city engineer find that the proposed subdivision complies with the requirements of the Subdivision Map Act, Government Code § 66410 et seq., and this chapter as to area, improvement and design, floodwater drainage control, appropriate improved public roads, sanitary disposal facilities, water supply availability and environmental protection.

Sec. 78-105. - Time limit for decision.¶
The request for a waiver made pursuant to this division shall be granted or denied by the planning director and city engineer within 40 days of its filing, and the subdivider shall be notified of the action in writing. However, this time limit may be extended by mutual agreement between the planning director and the subdivider.

Sec. 78-106. - Certificate of waiver.¶
When a waiver is granted pursuant to this division, the planning director shall cause a certificate of waiver to be filed, within 15 working days after granting the waiver, with the recorder of the county in which any portion of the subdivision is located. The certificate shall state that the requirement of a parcel map has been waived and that the parcels comprising the subdivision may be sold, leased, financed or transferred in full compliance with the Subdivision Map Act, Government Code § 66410 et seq., and this chapter. Certificates and acknowledgments relating to dedications and improvements shall appear on the certificate of waiver whenever such certificates and acknowledgments would be required for a parcel map pursuant to the Subdivision Map Act, Government Code § 66410 et seq., or this chapter.
