Sec. 18-151. - Adopted.

That certain document, three copies of which are on file in the office of the city clerk, being the Uniform Housing Code, 1973 edition, published by the International Conference of Building Officials, is adopted as amended in this article as the housing code of the city, establishing minimum requirements for the protection of life, limb, health, property, safety and welfare of the general public and owners and occupants of residential buildings or structures in the city; establishing and prescribing enforcement proceedings; providing for the issuance of permits and the collection of fees therefor; and prescribing penalties for violation thereof.

Sec. 18-152. - Short title.

Whenever the term "Uniform Housing Code" or "housing code" appears in this Code or any city ordinance, such phrases shall be deemed and construed to refer and apply to the Uniform Housing Code adopted and amended by this article.

Sec. 18-153. - Amendments.

The Uniform Housing Code adopted in section 18-151 shall be amended as follows:

Section 103 is amended by adding to subsection (a) a new and additional paragraph to read as follows:

The requirements of this housing code are applicable to any new or proposed residential building construction or alteration and to any existing substandard buildings as defined herein.

Section 103 is further amended by adding a new and additional subsection (d) to read as follows:

(d) Conflict with zoning. The provisions of this code shall be subject to all of the provisions of the Code of the City of San Fernando, California, as amended, and all ordinances of the city and resolutions adopted pursuant thereto relative to zoning. In case of any conflict between this Uniform Housing Code and the provisions of the Code of the City of San Fernando, California, and the ordinances and resolutions of the city relative to zoning, then the zoning provisions, laws, ordinances and resolutions shall govern.

Section 201(b) is amended to read as follows:

(b) Right of entry.

(1) Emergency. The building official or his duly authorized representative shall have the authority to enter any building or premises for the purpose of investigating the existence of suspected or reported damages or defects which constitute an immediate hazard to public safety or health.

(2) No emergency. Except in emergency situations as defined in paragraph (1) of this subsection above, the building official or his duly authorized representative shall not enter any building or premises without the consent of the owner or occupant thereof, unless he possesses a search warrant authorizing entry and search of premises.

Section 203 concerning the housing and advisory appeals board is deleted and specifically not adopted.

Section 204 concerning penalties is deleted and specifically not adopted.

Section 401 is amended by adding the definition of the term building official to read as follows:

Building official. Building official means the director of building and planning of the City of San Fernando and is the officer charged with the administration and enforcement of this code, or his regularly authorized deputy.
