Subdivision I. - In General

Subdivision II. - Permit

Sec. 102-141. - Required; application.

(a) It shall be unlawful for any person to operate or drive a taxicab in the city without first having obtained a driver's permit from the chief of police. All persons applying for such a permit shall file with the chief of police a sworn application which shall set forth the following:

(1) The experience of the applicant in the transportation of passengers.

(2) A concise history of his employment.

(3) The educational background of the applicant.

(4) Two recent photographs, size 1½ inches by 1½ inches.

(5) The names and addresses of four city residents who have known the applicant for a period of at least one year and who will vouch for the sobriety, honesty and general good character of the applicant.

(6) A copy of the certificate obtained in compliance with Government Code § 53075.5.

(b) An application fee in an amount set by resolution of the city council shall accompany each application for a driver's permit.

Sec. 102-142. - Driver requirements.

The chief of police shall not issue a taxicab driver's permit to any person:

(1) Under the age of 21 years.

(2) Not a citizen of the United States or who has not filed a petition for naturalization or who does not possess a valid green card.

(3) Not possessing a valid driver's license issued by the state.

(4) Who has been convicted of driving a vehicle recklessly or while under the influence of intoxicating liquors or narcotics.

(5) Who has been convicted of a felony or crime involving moral turpitude.

(6) Who has violated any section of this Code which in the chief of police's opinion affects the applicant's qualifications as a driver.

(7) Who is not employed as, or does not have an offer of employment as, a taxicab driver in the city.

Sec. 102-143. - Issuance.

Upon completion of his investigation, which shall include a complete review of a police report on the applicant, if the chief of police finds the applicant for a taxicab driver's permit is a fit and proper person to be a taxicab driver in the city, he shall issue or cause to be issued to the applicant a taxicab driver's permit. Such permit shall have affixed thereto a photograph as required by section 102-141 of this subdivision.

Sec. 102-144. - Denial.

If, upon completion of his investigation, the chief of police finds the applicant is not a fit and proper person to be a taxicab driver, he shall refuse to issue a taxicab driver's permit to the applicant.

Sec. 102-145. - Display.

Every taxicab driver issued a permit under section 102-143 of this subdivision shall post his driver's permit in such a place as to be in full view of all passengers while such driver is operating a taxicab.

Sec. 102-146. - Change of employment.

(a) The taxicab driver's permit shall become void upon termination of employment.

(b) The employer shall notify the city upon termination of employment.

(c) The driver shall return the permit to the city upon termination of employment.

Sec. 102-147. - Change of address.

If a taxicab driver changes his residential address, he shall, within ten days thereafter, notify the chief of police for the purpose of having his driver's permit changed so as to properly designate his residential address.

Sec. 102-148. - Suspension or revocation.

A driver's permit issued under this subdivision may be suspended or revoked at any time by the chief of police if the holder thereof has:

(1) Been convicted of a felony or a crime involving moral turpitude; using, possessing, selling or transporting narcotics; or imparting information for obtaining narcotics.

(2) Been convicted of driving recklessly or while under the influence of liquor or narcotics.

(3) Had his state driver's license revoked or suspended.

(4) Been convicted of any of the, offenses set forth in Vehicle Code §§ 20001, 22350, 22351, 23152 and 23103 and amendments thereto, or any combination of either or any of such offenses.

(5) Charged or received a fare in excess of the rates provided for in this article or violated any of the other sections of this article.

(6) Been determined by the chief of police, for any reason, including but not limited to those reasons set forth in section 102-142 of this subdivision, whether specifically set forth in this section or not, after due investigation, to be an unfit person to drive a taxicab.

Sec. 102-149. - Revocation hearing.

Revocation of a taxicab driver's permit shall be made only after a hearing granted to the holder of such permit before the chief of police, after five days' notice to the permit holder setting forth the grounds of the complaint against him and stating the time and place where such hearing will be held. Upon revocation of any driver's permit, such permit shall be surrendered forthwith to the chief of police. The decision of the chief of police shall be final and conclusive.

Sec. 102-150. - Term; renewal, fee.

Each taxicab driver's permit approved by the city administrative officer shall be an annual permit and shall be automatically renewable by the chief of police if, in the opinion of the chief of police, the driver should receive a subsequent permit. A permit fee shall be required for renewals.
