§ 8.04.010. Generally.

The following words, phrases, and designations, when used in this title, shall have the following meanings, unless from the context a different meaning is specifically defined and more particularly directed to the use of such words, phrases, or designations.

§ 8.04.015. City engineer.

"City engineer" shall mean the deputy director of public works of the city of San Bruno, or other person appointed by the city manager to serve in that role.

§ 8.04.020. Commission.

"Commission" means the public utilities commission of the state.

§ 8.04.025. Director of community services.

"Director of community services" shall mean the director of community services of the city of San Bruno or authorized designee.

§ 8.04.030. Director of public works.

"Director of public works" means the director of public works of the city of San Bruno or authorized designee.

§ 8.04.040. Encroachment.

"Encroachment" means going over, upon or under, or using a public right-of-way in such a manner as to prevent, obstruct or interfere with its normal use, including, but not limited to, the performance thereon of any of the following acts: (1) excavating, filling or disturbing the right of way; (2) erecting or maintaining any flag, banner, post, sign, pole, fence, guardrail, wall, loading platform, mailbox, pipe, conduit, wire or other structure on, over, or under a right-of-way; (3) planting any tree, shrub, grass or other growing thing within a right-of-way; (4) placing or leaving on a right-of-way any rubbish, brush, earth or other material of any nature whatsoever; (5) constructing, placing or maintaining on, over, under or within the right-of-way any pathway, sidewalk, driveway, curb, gutter, paving or other surface or subsurface drainage structure or facility, any pipe, conduit, wire or cable; (6) traveling on the right-of-way by any vehicle or combination of vehicles or object of dimension, weight or other characteristic prohibited by law without a permit; (7) lighting or building a fire; (8) constructing, placing, planting or maintaining any structure, embankment, excavation, tree or other object adjacent to a right-of-way which causes or will cause an encroachment.

§ 8.04.050. Other plantings.

"Other plantings" means any trees, shrubs, grass or ground cover planted within street right-of-way or easements or in proximity thereto or on adjoining property which do not qualify as street trees.

§ 8.04.060. Owner.

"Owner" means a person vested with the title to a parcel of real property.

§ 8.04.065. Parklet.

"Parklet" means a temporary sidewalk extension installed on public parking space(s) within the public right-of-way, that provides more space and amenities for outdoor dining operated and maintained by the business establishment conducting the outdoor dining. The amenities may include tables, chairs, umbrellas, and other items for the consumption of food and beverages served by the restaurant or food or beverage service use.

§ 8.04.070. Planting strip.

"Planting strip" means the area between the curb and sidewalk where sidewalks are separated from the curb.

§ 8.04.080. Poles, overhead wires, and associated overhead structures.

"Poles, overhead wires, and associated overhead structures" means poles, towers, supports, wires, conductors, stubs, platforms, crossarms, braces, transformers, transformer pads, insulators, cutouts, switches, communication circuits, appliances, attachments, and appurtenances upon, along, across, or over the streets of the city, and used or useful in supplying electricity communication, telephone service or similar or associated service.

§ 8.04.090. Repair.

"Repair" means the construction, reconstruction, repair, replacement, restoration or improvements of any sidewalks, streets, parkways, or infrastructure within the right-of-way.

§ 8.04.100. Sidewalk.

"Sidewalk" means a sidewalk, park, parkway, or parking strip maintained in the area between the property line and the curb line, driveway, curbing, bulkhead, retaining wall, or other work for the protection of any sidewalk or walkway or any park or parking strip located in any public street in the city.

§ 8.04.110. Street.

A. Except as provided in subsections B and C, "street" means any street, way, lane, place, thoroughfare, or easement in the city which has been dedicated to the public and which dedication has been duly accepted.

B. For purposes of Sections 8.08.030, 8.08.040, and 8.08.050, "street" means a way or place of whatever nature, publicly maintained and open to the use of the public for purposes of vehicular travel.

C. For purposes of Chapter 8.24, "street" means any dedicated area established for public travel in the city including the planting strip, sidewalk area, roadway area, right-of-way and easements adjacent thereto.

§ 8.04.120. Street tree.

"Street tree" means any tree planted after the adoption of Ordinance No. 1320 within any street, right-of-way, or easement adjacent thereto.

§ 8.04.130. Underground utility district.

"Underground utility district" or "district" means that area in the city within which poles, overhead wires and associated overhead structures are prohibited as such area is described in a resolution adopted pursuant to Section 8.28.040.

§ 8.04.140. Utility.

"Utility" means all persons supplying electric, communication, telephone service, or similar or association by means of electrical materials or devices.
