§ 8.08.010. Obstructions—Prohibited generally—Exceptions.

A. No person shall erect or maintain, or cause to be erected or maintained, in or upon any street in the city any structure, pipe, aqueduct, flume, bridge, fence, or any other subject in or above the surface thereof in such manner as:

  1. To interfere with the free use and enjoyment of such street by the public; or

  2. To interfere with the intended use of such street; or

  3. To prevent the free access to any property fronting thereon.

B. Every obstruction, fence, barricade, structure, excavation, embankment, deposit of materials or other things the placement, keeping, or maintenance of which is prohibited by this chapter is a public nuisance. Any such nuisance may be summarily abated by the director of public works, either by removing the same or by remedying the condition caused thereby. The cost thereof shall be a charge against the person responsible therefor and shall be recoverable by legal action undertaken in a court of competent jurisdiction. If the nuisance is caused by the owner of property fronting upon a street, the cost of abatement shall constitute a lien upon such real property. The amount of such lien shall be collectible at the same time and in the same manner and shall bear the same penalties as amounts assessed for general municipal taxes of the city. The procedure for assessment of cost of abatement of the nuisance shall be as set forth in Chapter 5.08 of this code.

C. This section shall not apply to any poles, conduits, wires, cables, hydrants, pumps, signs, or other devices which have been erected or maintained pursuant to authorization of the city council or encroachment permit.

§ 8.08.020. Obstructions—Merchandise displays, etc.

A. No person shall place or cause, suffer, permit, or allow to be placed on or over any sidewalk or public right-of-way any sign, flag, banner, goods, wares, or merchandise for the purpose of exhibition, display, or advertisement.

B. This section shall not apply to any sign permitted to extend over a sidewalk or portion thereof pursuant to the zoning ordinance.

§ 8.08.030. Roller skates prohibited in commercial districts.

No person shall ride upon rollerskates or ride in or by means of any coaster, toy vehicle, or similar device upon any street, or upon any sidewalk abutting any real property in any commercial zoning district or planned development zoning district zoned for commercial use under the zoning ordinance.

§ 8.08.040. Painting or placement of chalk marks upon streets and sidewalks.

No person shall paint or place any chalk or other mark, or cause, suffer, allow, or permit the painting or placement of any chalk or other mark upon any street or sidewalk except under the authority of an encroachment permit under this chapter or under the authority and direction of the director of public works.
