§ 1.12.010. Release of persons arrested.

The provisions of Sections 853.5 and 853.6 of the Penal Code shall govern the release of persons arrested for offenses declared to be infractions or misdemeanors.

§ 1.12.020. Violation of written promise to appear.

Any person wilfully violating his or her written promise to appear in court is guilty of a misdemeanor, regardless of the disposition of the charge upon which he or she was originally arrested.

§ 1.12.030. Prosecution.

Notwithstanding any other provision of this code, whenever a violation of any section contained in this code is punishable as a misdemeanor, the city attorney may specify that the offense is an infraction, and proceed with prosecution as an infraction, unless the defendant, at the time of arraignment or plea, objects to the offense being made an infraction, in which event the court may elect to have the complaint amended to charge as a misdemeanor, and the case shall proceed on a misdemeanor complaint.
