§ 5.01.020 PURPOSE.

The purpose of the drainage impact fee herein established is to derive revenue which shall be used for the construction and reconstruction of certain storm drainage facilities spelled out in the San Felipe Lake drainage plan pursuant to Cal. Gov’t Code § 66483.

§ 5.01.021 DRAINAGE IMPACT FEE FUND.

All drainage impact fees collected pursuant to the provisions of this article shall be placed into special funds which are hereby created and established for such purposes and which shall be known as the Drainage Impact Fee Fund. Revenue deposited into the Fund shall be used for the construction, reconstruction and related work for the improvement of the storm water drainage facilities in the benefit area. Separate funds may be established for separate projects.

§ 5.01.022 COLLECTION OF FEES.

No building permit shall be issued after the effective date of the ordinance codified in this article for the construction or modification of any building or structure on any land in benefit areas unless the drainage impact fees have been paid. In the case of major subdivisions the fee shall be collected prior to Board approval of the map. In all other cases, the fee shall be collected before a building permit shall be issued.

§ 5.01.023 FEES.

(A) The drainage impact fee shall be fixed by the Board of Supervisors, from time to time by resolution. The fees established and fixed by the resolution shall be adjusted on July 1 and January 1 of each year, based upon the change in the United States Average Engineering News Record Construction Cost Index (ENR), calculated as follows:

(B) The adjusted fee shall be rounded to the nearest $10.

§ 5.01.024 DRAINAGE BENEFIT AREAS.

(A) The San Felipe Lake drainage benefit area shall be established by the Board of Supervisors by resolution.

(B) This will include a text and a map of the area. The benefit area may be adjusted or rescinded by resolution of the Board of Supervisors.

(C) An implementation program including a priority list of identified projects and capital improvement plan will be adopted, and revised as needed, by the Board of Supervisors.

§ 5.01.025 FAILURE TO PAY FEE.

Failure to pay drainage impact fees to the county shall result in the building permit application being denied by the Building Official.
