§ 3.05.145 ESTABLISHED.¶
The San Benito County Parks and Recreation Commission is hereby established consisting of nine members.

§ 3.05.146 ADVISORY ROLE.¶
The Commission is advisory to the San Benito County Board of Supervisors.

§ 3.05.147 PURPOSE.¶
The purpose of the Commission is to make recommendations to the Board of Supervisors concerning the following for all current and future county parks, excepting the Veterans’ Memorial Park:
(A) Use of existing county park facilities including the development of park improvements to the facilities;
(B) Need for future park facilities and their location(s);
(C) Development of recreational activities and programs at county park facilities;
(D) Use of federal, state and local funds for parks and recreation facilities and activities;
(E) Joint use of park facilities with other agencies;
(F) Coordination with federal, state and local parks and recreation agencies to enhance the use of park facilities throughout the county; and
(G) Other issues as deemed appropriate by a majority vote of the Board of Supervisors.

§ 3.05.148 MEMBERS.¶
(A) The Commission shall consist of seven members. Each Supervisor shall recommend one member to be appointed by a majority vote of the Board of Supervisors. One member shall be recommended by the Memorial Park Commission to be appointed by a majority vote of the Board of Supervisors. One member shall be recommended by the San Benito County Historical Society to be appointed by a majority vote of the Board of Supervisors.
(B) Attendance by Commission members at all Commission meetings is vital to the proper functioning of the Commission. Whenever a member is absent for three consecutive meetings or has failed to attend a minimum of eight of the last 12 regularly scheduled monthly meetings, the Chairperson shall notify the appointing agency of the absences. Then the appointing agency may deem the member has resigned and appoint a replacement.

§ 3.05.149 TERM OF MEMBERS.¶
The term of the five members appointed by the Board of Supervisors shall be coterminous with that of the duly elected Supervisor who recommended him or her for appointment or until a successor is appointed to the Commission, whichever is later. The member representing the Memorial Park Commission shall serve at the pleasure of the Memorial Park Commission and the member representing the San Benito County Historical Society shall serve at the pleasure of the Historical Society Board of Directors.

§ 3.05.150 VACANCY.¶
Should a vacancy occur, it shall be filled in accordance with § 3.05.148 above.

§ 3.05.151 COMPENSATION.¶
All of the members of the Commission shall serve without compensation. Members may be reimbursed for actual expenses, including travel, lodging and meal expenses, incurred while on official business of the Commission which have been approved by the Board of Supervisors.

§ 3.05.152 OFFICERS.¶
(A) The Commission shall appoint a chairperson and vice-chairperson by majority vote of the Commission at the first meeting following July 1 of each year. The Chairperson shall preside at meetings of the Commission, call special meetings where necessary, and perform other duties customarily performed by a chairperson.
(B) The Vice-Chairperson shall serve in the absence, inability, or unwillingness of the Chairperson to act. In the absence of the Chairperson and Vice-Chairperson, the Commission members shall appoint one of the members to act as Chairperson pro tempore. When the office of Chairperson or Vice-Chairperson becomes vacant, the Commission shall elect a successor at the earliest meeting practicable.

§ 3.05.153 MEETINGS.¶
(A) The Commission shall convene quarterly, and as more frequently as may be determined by the Commission or the Chair.
(B) Regular meetings of the Parks and Recreation Commission shall be held at the county seat of the county, in the Board of Supervisors’ Chambers located at 481 Fourth Street, Hollister. The location of Commission meetings may be changed by the Commission.
(C) The change of location of the regular meeting of the Commission shall be adopted by ordinance, resolution, bylaw, motion, or other rule required for the conduct of business by the Parks and Recreation Commission at a regular meeting of the body.

§ 3.05.154 QUORUM.¶
Four members of the Commission shall constitute a quorum for the transaction of business of the Commission.

§ 3.05.155 EFFECTIVE DATE.¶
This article shall take effect and be in force 30 days after the date of its passage and approval. Prior to the expiration of 15 days from the final passage hereof, the Clerk of the San Benito County Board of Supervisors shall cause this article to be published in a newspaper of general circulation in the County of San Benito.
