6-2.01 - Publications and sales regulated.

No person shall publish and/or conduct any going-out-of-business sale, auction sale, liquidation sale, or sale of a similar nature, except in conformity with the provisions of this chapter.

6-2.02 - Publications and sales: Time limited.

All publications and all sales referred to in Section 6-2.01 of this chapter shall not extend for more than sixty (60) days after the date of the first advertisement.

6-2.03 - Continuing businesses: Business licenses: Taxes.

Any business which continues in operation for more than the sixty (60) day period described in Section 6-2.02 of this chapter or which reopens within twelve (12) months thereafter shall be required forthwith to obtain a new business license at a tax equal to the tax most recently paid for such business or its predecessor or at a tax of Five Hundred and no/100ths ($500.00) Dollars, whichever is higher.

6-2.04 - Definitions.

For the purposes of this chapter, unless otherwise apparent from the context, certain words and phrases used in this chapter are defined as follows:

(a) "Sale" shall mean any sale, or any offer to sell, to the public or any person, goods, wares, or merchandise on order, in transit, or in stock in connection with a declared purpose that such sale is anticipatory to or a part of a termination, liquidation, revision, windup, discontinuance, removal, dissolution, going out of business, or abandonment of the business or a portion of the business conducted at any location.

(b) "Advertise", "advertisement", "advertising", "publish", and "publication" shall mean any means, whether oral, written, lettered, or printed, used for conveying notice of a sale or notice of intention to sell, including, but not limited to, an oral or written announcement by proclamation or outcry, newspaper, advertisement, magazine advertisement, handbill, written or printed display, billboard display, poster, or radio announcement.

6-2.05 - Reopened businesses.

Regardless of the name or structure, any business shall be deemed to have reopened if:

(a) The nature of the business is similar; and

(b) Less than fifty (50%) percent of the ownership has changed.
