4-6.01 - Intoxication in public places.

It shall be unlawful for any person to be drunk or intoxicated:

(a) On any public highway;

(b) In any public place;

(c) In or about any automobile in a public place; or

(d) In any place open to public view.

4-6.02 - Intoxication on private premises.

It shall be unlawful for any person, to the annoyance of any other person, to be drunk or intoxicated on any private premises or in any private house in the Town.

4-6.03 - Use of alcohol in parks and playgrounds.

It shall be unlawful for any person to drink any beer, wine, or other alcoholic beverage or have in his or her possession any bottle, can, or other receptacle containing any alcoholic beverage in any Town park or playground.

4-6.04 - Use of alcohol in certain public and private places.

It shall be unlawful for any person to drink any beer, wine, or other alcoholic beverage or have in his possession any bottle, can, or other receptacle containing any alcoholic beverage, which receptacle has been opened or a seal thereof broken or the contents thereof partially removed, on any public street, sidewalk, passageway, or parking lot or in any private parking lot or passageway open for use by the public.

4-6.05 - Exceptions: Permits.

Notwithstanding the provisions of Sections 4-6.03 and 4-6.04 of this chapter, the use or possession of beer or wine in places otherwise prohibited shall be lawful upon written authorization by the Chief of Police to an organization sponsoring a special event. The Chief of Police may issue such authorization when in his judgment the organization has made adequate provisions for policing.

4-6.06 - Violations: Penalties.

Any person violating any provision of this chapter shall be guilty of an infraction or shall be guilty of a misdemeanor if cited or arrested for a second offense under this chapter within one year after a prior conviction.
