Sec. 30-12.20. - Permit required for temporary street closing.

No person shall block off any public street or hold or be a participant in any block party, meetings, gathering, rally, contest or other event, or make any other use of a public street which obstructs the normal traffic thereupon, without first obtaining a permit from the city manager authorizing the temporary closing of such street.

Sec. 30-12.21. - Permit application.

Any person seeking a permit for any of said purposes shall file an application with the city manager, on forms to be provided by the official, and setting forth the following information:

(a) The name, address and telephone number of the person or corporation seeking to block any street or streets, or hold an event thereon;

(b) If to be held by an organization, the name, address and telephone number of the headquarters of same, and of the officers of the organization;

(c) The name, address and telephone number of the chairman of the event, or the person otherwise responsible for its conduct;

(d) The date on which the event or use is to occur;

(e) The portion of the streets to be closed;

(f) The approximate number of persons and/or animals and vehicles, and the kinds and types thereof, who will take part in the event or use;

(g) The approximate hours at which the event or use will start and terminate;

(h) Such additional information as the city manager shall deem reasonably necessary in determining whether or not the permit shall issue, under the standards set forth below.

Sec. 30-12.22. - Time of filing application.

An application for a street-closing permit shall be filed with the city manager not less than ten days before the date on which it is proposed to conduct the event or use. However, where good cause is shown, the city manager shall have the authority to consider an application hereunder which has been filed less than ten days before the proposed date.

Sec. 30-12.23. - Standards for issuance.

The city manager shall issue the permit, as herein provided, upon a finding that:

(a) The temporary closing of the street to traffic will not substantially inconvenience the persons who would normally make use of such street;

(b) The conduct of the proposed event or use of the street is not reasonably likely to cause injury to persons or damage to property, provoke disorderly conduct or create a disturbance of the peace;

(c) The conduct of the event or the proposed use will not require the diversion of so great a number of police officers of the city as to impair the normal police protection of the city;

(d) The connection of persons, animals or vehicles will not unreasonably interfere with proper fire and police protection in the vicinity of the event or other areas of the city;

(e) The event is not to be held for the principal purpose of advertising any product, goods or business or for private profit;

(f) The adequate cleanup of litter or debris resulting from the holding of such event is assured.

Sec. 30-12.24. - Notification by city manager.

The city manager shall act upon the application for a street-closing permit within five days after the filing thereof. If the city manager disapproves of the application, he shall mail to the applicant, within five days after the date on which the application was filed, a notice of his action, stating the reasons for his denial of the permit.

Sec. 30-12.25. - Appeal to city council.

Any person aggrieved by such action of the city manager shall have the right to appeal to the city council by filing with the city clerk, within five days from and after the date of denial, a written notice of appeal which shall set forth the grounds for such appeal. The city council shall act thereon as expeditiously as possible.

Sec. 30-12.26. - Contents of permit.

Each permit issued hereunder shall specify the following:

(a) The specific portions of the street to be closed to traffic;

(b) The period of time during which the street may be closed to traffic;

(c) Requirements for placement and removal of barricades and the marking and lighting thereof;

(d) Requirements for the protection of persons and property abutting and near the portion of the street to be closed from danger or annoyance which may be caused by such use;

(e) Requirements and instructions for removal of litter or debris created in connection with the event or use;

(f) Such other restrictions, conditions or limitations as the city manager shall deem necessary to the enforcement of these sections.

Sec. 30-12.27. - Conduct of permittee.

Each permittee hereunder shall comply with all terms, conditions and provisions of the permit and with all applicable laws of the state of California and of the city of Salinas.

Each such permittee shall, in addition, see to it that the person in charge of the event shall at all times carry the street-closing permit upon his person during the conduct of the event.

Sec. 30-12.28. - Revocation of permit.

The city manager shall have the authority to revoke a permit issued hereunder in the event that he shall find and determine that any term, condition, restriction or limitation of such permit shall have been violated, or is being violated, or if he should find that, due to changed circumstances, any one or more of the standards specified in Section 30-12.23 hereof has not been satisfied. Appeal from any such revocation shall be in accordance with Section 30-12.25 above.
