Sec. 20-124. - Prohibited; type of signs allowed.

Except as hereinafter provided, it shall be unlawful for any person to install or maintain upon any lot or parcel of land located within the city any advertising device which is intended to attract the attention of passing motorists and which thereby constitutes a hazard to such motorists, or to pedestrians, or public and private property.

The advertising devices proscribed by this section shall include but not be limited to beacons, pennants, flags and spinning disks or other wind-activated, illuminated or light-reflecting contrivances; provided, that this section shall not be construed so as to prohibit the use, installation or maintenance of any of the following:

(a) Advertising signs or structures as defined and permitted under the provisions of chapter 3 and which are not of a flashing, moving or illuminated type likely to cause vehicular accidents by diverting the attention of passing motorists.

(b) Christmas or other ceremonious holiday decorations.

(c) Decorations installed in or upon the public streets or other public places or buildings in connection with parades, events and ceremonies authorized by the council.

(d) The flags of the United States, the State of California or of any other state or nation or local government entity.

(e) Warning devices, lights or flags installed or maintained for the purpose of giving notice of a hazardous condition.

Sec. 20-125. - Violation of article as public nuisance.

Any distracting advertising device installed or maintained in violation of any of the provisions of this article is hereby declared to be unlawful and a public nuisance, and the city attorney, upon direction of the council, shall commence proceedings for the abatement, removal and enjoinment thereof in the manner provided by law, and shall take such other steps, and shall apply to such courts as may have jurisdiction to grant such relief, as will abate and remove such device and restrain and enjoin any person from installing or maintaining any such device in violation of these provisions. The remedies herein provided shall be cumulative and not exclusive.
