8.72.010 Operating regulations.

Any searchlight operated within the city shall comply with the following regulations:

A. Searchlights shall not be operated so as to constitute a traffic hazard or a nuisance.

B. Searchlights shall be operated so as to avoid directing the beam at any building.

C. Searchlights shall be so operated that the beam is not displayed at an angle greater than forty-five (45) degrees from the vertical.

D. Equipment shall not be permitted between curbs where parking is prohibited.

E. Equipment shall not be operated from any sidewalk area.

F. Equipment shall not be stored in curb parking spaces when parking time limit is in effect. (Prior code § 35.01.001)

8.72.020 Permit-Required.

It is unlawful for any person to use or permit to be used any type of lights commonly designated as "searchlights," for the purpose of advertising or for any other purpose without first securing a separate written permit from the chief of police for each such location at which a searchlight is desired to be used or operated. Violation of this provision is an infraction.

This section shall not apply to any governmental agency. (Prior code § 35.01.002)

8.72.030 Application.

Any person desiring to operate or use a searchlight in the city shall file with the chief of police an application therefor on forms to be provided by the chief of police. Such application shall contain the following information:

A. The name and address of the person making application;

B. The location at which it is desired to use or operate a searchlight;

C. The period for which a permit is desired;

D. The hours during which the searchlight is to be operated;

E. The name of the person who will be in charge of operating the searchlight. (Prior code § 35.01.003)

8.72.040 Permit-Fees.

To defray the cost to the city of administering the provisions of this chapter, there shall be payable in advance to the city assessor by each applicant, such fees as are established by resolution of the city council.

Such fees shall be in addition to any other licenses or fees required by any other law of the city. (Prior code § 35.01.004)

8.72.050 Permit-Revocation.

Any permit required by Section 8.72.020 of this chapter issued by the chief of police may be revoked by him or her at any time in the event he or she finds that the owner or operator of the searchlight has failed to operate the same in accordance with the provisions of Section 8.72.010 of this chapter. 8.72.060 Insurance requirements.

Each applicant for a permit required by this chapter shall show evidence of insurability by having liability and property damage insurance in force at all times during the time a permit is in effect in sufficient amounts to protect the holder of the permit from liability and to hold the city harmless from any damages, claims or causes of action by reason of the issuance of the permit and operation of such searchlights.
