5.124.400 Massage therapy establishment's hours of operations.¶
No massage therapy establishment shall operate between the hours of 10:00 p.m. and 6:00 a.m. (Ord. 2021-0016 § 26)
5.124.410 Massage therapy establishment's exterior lighting.¶
A. A massage therapy establishment site shall have adequate lighting for customer safety and visibility, including exterior white lights using LED lamps with full cutoff fixtures to limit glare and light trespass.
B. A massage therapy establishment site shall ensure that its exterior lighting avoids spill-over illumination to adjacent streets and properties. (Ord. 2021-0016 § 26)
5.124.420 Display of massage therapy services and massage establishment permit.¶
A. No massage therapy establishment shall operate unless a list of the establishment's services and prices are displayed in a conspicuous place at or near the entrance of the site. The massage therapy services shall be described in English, in readily understandable language.
B. No massage therapy establishment shall offer or allow any person to provide a massage therapy service that is not displayed as described in subsection A.
C. No massage therapy establishment shall operate unless its permit is displayed in a conspicuous place inside of the site so that the same may be readily seen by customers entering the premises. (Ord. 2021-0016 § 26)
5.124.430 Video surveillance of a massage therapy establishment.¶
A massage therapy establishment shall have a video assessment and surveillance system on the site. The system shall have a minimum of one camera on the exterior, at the main entrance. Cameras shall be capable of recording activity in the day and at night, with a resolution of no less than two megapixels and a minimum frame rate of 15 frames per second. The system shall retain video for a minimum of 30 calendar days and be running during all hours of operation. (Ord. 2021-0016 § 26)
5.124.440 Registry of a massage therapy establishment.¶
A. Massage therapy establishments shall maintain a written registration of the daily operations of the establishment, in English. The registration shall be available for inspection by the city during regular business hours of the massage therapy establishment. The registration must be retained for one year.
B. The registration shall contain a daily record of the following information:
The names of all certified massage therapy practitioners as they appear on the California Massage Therapy Council certificates and the certificate numbers;
The names of all permitted massage therapy practitioners;
The hours worked and the massage therapy services performed by a massage therapy practitioner and certified massage therapy practitioner;
For each massage therapy service performed:
a. The time the service was provided, and
b. The printed name and signature of the person entering the information on the registration; and
- The name of the manager of the massage therapy establishment. (Ord. 2021-0016 § 26)
5.124.450 Minors.¶
No person under 18 years of age shall be allowed to perform any massage therapy service on the site. (Ord. 2021-0016 § 26)
5.124.460 Access to a massage therapy establishment.¶
A. All front, reception, hallway, and exterior doors-except single-stall restrooms, back, and exterior doors used solely by owners, employees or other persons retained by the massage therapy establishment-shall be unlocked during business hours, except as may be allowed by applicable law.
B. A massage therapy establishment shall ensure that customers enter or leave the establishment only through the front door.
C. No massage therapy establishment shall allow any person to be in any cubicle, room, booth, or any area of the site where a customer is present, if the area has a door which is capable of being locked, unless that door is an exterior door. (Ord. 2021-0016 § 26)
5.124.470 Areas where services are prohibited.¶
A. No massage therapy establishment shall allow a massage therapy service to be given within any cubicle, room, booth, or any area within an establishment that is fitted with a lock of any kind, unless the doors are exterior doors.
B. No massage therapy establishment shall allow a massage therapy service that is in violation of this chapter. (Ord. 2021-0016 § 26)
5.124.480 Privacy.¶
A. No massage therapy establishment may allow an employee to be present in any room with another person, unless that person's genitals, gluteal cleft, and anus are fully covered.
B. A massage therapy establishment site must have windows that allow for an unobstructed view into the waiting or lobby area of the site at the front entrance. The windows shall be completely transparent with no treatment that reduces or diminishes visibility into the interior.
C. A massage therapy establishment site shall have no more than 10% of the square footage of the exterior windows and transparent doors blocked by advertising, signs, shelves, curtains, blinds, or anything else during the hours of operation. All advertising, signs, and shelving shall be placed and maintained in a manner that ensures an unobstructed view of the site's interior from the public right-of-way. (Ord. 2021-0016 § 26)
5.124.490 Prohibition against residing on the site.¶
No person shall reside on the site of a massage therapy establishment unless the site is primarily used for residential purposes and the massage therapy services are only out-call massage therapy services. (Ord. 2021-0016 § 26)
