5.124.300 Qualifications of a permitted massage therapy practitioner.

A massage therapy practitioner is eligible for a massage therapy practitioner permit if the person meets and maintains the following qualifications:

A. Possesses a diploma or certificate from a recognized school of massage therapy after completing at least 250 hours of classroom instruction; and

B. Has completed at least 12 hours of continuing education in the practice of massage therapy, during the preceding calendar year, provided by any of the following:

    1. A recognized school of massage therapy;
    1. The California Board of Registered Nursing; or
    1. An accredited college or university. (Ord. 2021-0016 § 26)

5.124.310 Massage therapy practitioner hours of operation.

A massage therapy practitioner may provide massage therapy services only between the hours of 6:00 a.m. and 10:00 p.m. (Ord. 2021-0016 § 26)

5.124.320 Massage therapy services in a permitted residence.

A massage therapy practitioner may not provide massage therapy services at a permitted residence as defined in section 17.228.200. (Ord. 2021-0016 § 26)

5.124.330 Massage therapy services limited to one massage therapy practitioner.

No more than one massage therapy practitioner may provide massage therapy services to any person at the same time. (Ord. 2021-0016 § 26)

5.124.340 Prohibited contact and prohibited appearance.

A. No massage therapy practitioner may, intentionally or unintentionally, contact the genitals or anal area of any customer.

B. No massage therapy practitioner, while performing any task or massage therapy service, may be present in any room with another person, unless that person's genitals, gluteal cleft, and anus are fully covered. (Ord. 2021-0016 § 26)

5.124.350 Display of permit.

A. A massage therapy practitioner shall display their permit in a conspicuous place on the site so that the same may be readily seen by persons entering the site.

B. A massage therapy practitioner who is engaged in providing out-call massage therapy services shall ensure that the permit is available for inspection at all times. (Ord. 2021-0016 § 26)

5.124.360 Insurance requirements.

A massage therapy practitioner must maintain general liability insurance coverage in the minimum amount of $1,000,000 per occurrence and must provide proof of insurance upon request of the city. Notwithstanding the aforementioned, if the practitioner is an employee of a massage therapy establishment and that establishment carries the minimum amount of general liability insurance coverage, the practitioner is not subject to this section. 5.124.370 Business operations tax required.

A massage therapy practitioner must pay the applicable city business operations tax pursuant to chapter 3.08. (Ord. 2021-0016 § 26)
