8.70.010 Definitions.

The following definitions apply in this chapter:

"Air quality index" means the current air quality index for particulate matter measuring 2.5 micrometers or less (Current PM2.5 AQI) for downtown Sacramento, as reported by the Sacramento Metropolitan Air Quality Management District. If an air quality index for downtown Sacramento is not available, the index for the nearest geographical location will apply.

"Portable blower" means a portable machine that emits a concentrated stream of air and is typically used in landscape maintenance to push, propel, or blow dirt, dust, leaves, grass clippings, trimmings, green waste, solid waste, or debris. (Ord. 2020-0042 § 1)

8.70.020 Use of portable blowers.

No person shall operate a portable blower when the air quality index is 101 and above. (Ord. 2020-0042 § 1)

8.70.030 Violations.

A. In addition to any other remedy allowed by law, any person who violates a provision of this chapter is subject to criminal sanctions, civil actions, and administrative penalties pursuant to chapter 1.28.

B. Violations of this chapter are hereby declared to be a public nuisance.

C. Any person who violates a provision of this chapter is liable for civil penalties of not less than $250 or more than $25,000 for each day the violation continues.

D. Any person who violates a provision of this chapter is guilty of an infraction.

E. All remedies prescribed under this chapter are cumulative and the election of one or more remedies does not bar the city from the pursuit of any other remedy to enforce this chapter. (Ord. 2020-0042 § 1)
