Sacramento Municipal Code Art. VI Procedures for Granting Variances from Construction Codes

Notwithstanding any other provisions of this code to the contrary, the director of the building inspections division shall have the authority, duty and obligation to grant variances from any and all provisions of the housing, building, electrical, fire, mechanical and plumbing codes of the city under the following conditions:

A. The premises or structure for which the variance is sought is situated upon land which is subject to an XH experimental residential housing designation imposed upon the property under the provisions of Article III of this chapter; and

B. Such variance is requested by a federal agency, its contractors or agents, in connection with the development and construction of prototype or experimental housing; and

C. Such variances are necessary to permit the construction, alteration, occupancy and disposal for intended use of the prototype or experimental housing and related structures to be constructed in conjunction with such housing. (Prior code § 52.06.601)

Requests for variances in connection with the construction of experimental residential housing shall be submitted to the director of the building inspections division by the federal agency or its contractors together with the plans and specifications required by the applicable provisions of the abovementioned construction codes. Prior to the issuance of the permits required for the construction proposed in the plans and specifications, the director may, if he or she wishes, return such plans and specifications with his or her comments and recommendations concerning such plans and variances. At any time thereafter and at the request of the federal agency or its contractors, the director shall summarily and without public hearing grant the requested variances. (Prior code § 52.06.602)
