Sacramento Municipal Code Art. V Procedures for Granting Variances from Zoning Regulations

After designation of the project site for residential experimental housing, the federal agency or its contractors shall submit to the planning director for his or her review and comment detailed development plans for each separate parcel of property within the project site. (Prior code § 52.05.501)

The development plans submitted to the planning director shall include the general schematic plan and more detailed plans of the various elements of the proposed development, such detailed plans to be prepared at a scale sufficient to permit evaluation of all pertinent site development details. In addition, elevation drawings shall be included which will clearly indicate the architectural character of the proposed development.

The plans shall indicate the number of dwelling units, the density of the dwelling units, and the types of dwelling units proposed and any related uses.

If the plans require the granting of variances from any or all of the regulations of the Planning and Development Code, each such variance shall be specifically described in documentation accompanying the plans. (Prior code § 52.05.502)

The planning director shall return the development plans to the person submitting the same with comments and recommendations which may include the comments and recommendations from other city departments and other public agencies affected by the development plans. (Prior code § 52.05.503)

At any time following review of the development plans by the planning director, the federal agency or its contractors may make application to the planning director for variances from any and all provisions of the Planning and Development Code when the granting of such variances is necessary to permit the construction, alteration, occupancy, or disposal for intended uses of experimental residential housing and related uses which are described in the development plans. The requested variances shall be summarily granted by the planning director without necessity of public hearing. No provision of the Planning and Development Code shall be applicable to the granting of such variances. (Ord. 2013-0021 § 54; prior code § 52.05.505)

If at any time following the review of the development plans by the planning director, minor modifications are made to such plans, the planning director may summarily grant such variances from the regulations of the Planning and Development Code as are necessary to accommodate such modifications. The procedure for granting such variances shall be that set forth in section 15.120.190. If major modifications are made to the development plans, the modified development plans shall be resubmitted to the planning director for review and comment in accordance with the procedure set forth in section 15.120.170.
