§ 21.15.010. Definitions.¶
As used in this chapter:
a.
"Applicable agencies"
mean each department, agency, commission, board, office or dependent district of the County whose budget includes funding for physical improvements.
b.
"Physical Improvements"
mean any new construction or renovation that adds value to an applicable agency's assets costing in excess of one hundred thousand dollars ($100,000), exclusive of the following:
Projects which the Board of Supervisors, the Deputy County Executive of Community Services, or the Deputy County Executive of Administration Services determine, in cases of emergency, are necessary for the continued conduct of County operations or services, or to avoid danger to life or property;
Improvements constructed pursuant to the provisions of the Improvement Act of 1911, the Municipal Improvement Act of 1913, the Mello-Roos Act, or other similar assessment district Acts.

§ 21.15.020. Format.¶
The County Executive shall develop and determine the format of the capital improvement program, and shall issue such written instructions and forms as are deemed necessary to elicit from the applicable agencies sufficient information to prepare their recommendations to the Board for a capital improvement program.

§ 21.15.030. Submittal.¶
The County Executive shall transmit to all applicable agencies materials necessary for preparation of their requests to construct physical improvements during the next capital improvement program period; and on such date as the County Executive specifies all applicable agencies shall file completed proposals for physical improvements with the County Executive.

§ 21.15.040. Preparation.¶
The County Executive shall review proposals submitted by the applicable agencies. From those submittals, the County Executive shall compile and transmit to Planning and Environmental Review the proposed new physical improvements and previously unfunded physical improvements in the Capital Improvement Program for review for consistency with the adopted County General Plan. Planning and Environmental Review staff shall provide the County Executive with a summary analysis evaluating the consistency of the proposed projects with the General Plan and its associated elements.
The County Executive shall compile their recommendations into a single capital improvement program document, inclusive of previously unfunded physical improvements, and ongoing physical improvements, with an attachment of the summary provided by Planning and Environmental Review which shall be transmitted to the Board of Supervisors along with the County Executive's Recommended Budget.

§ 21.15.050. Adoption by the Board of Supervisors.¶
The Board of Supervisors, as the planning agency, shall review the Capital Improvement Program, consider the recommendations of Planning and Environmental Review, and determine the consistency of the proposed physical improvements in the capital improvement program with the General Plan prior to the appropriation of funds for any proposal contained in said program. Notwithstanding any other provisions of this chapter, the Board reserves to itself total authority to establish priorities for the scheduling of the physical improvements within the capital improvement program and to determine the appropriateness of funding for such physical improvements. Board of Supervisors approval of funding for a physical improvement in the County's budget shall also be considered approval of a physical improvement for purposes of inclusion in the Capital Improvement Program.

§ 21.15.060. Amendments of the Capital Improvement Program.¶
Amendments to the Capital Improvement Program may occur from time to time throughout any fiscal year by action of the Board of Supervisors upon recommendation by any of the applicable agencies. New physical improvements or previously unfunded physical improvements shall be reviewed by Planning and Environmental Review, which shall provide the Board of Supervisors with a written summary analysis to support the Board's determination of consistency with the adopted General Plan and its associated elements.
