§ 11.20.010. Metropolitan Airport Terminal.

Unless and until otherwise authorized by the Director of Airports, the use of the Metropolitan Airport terminal apron space for the purposes mentioned in subsection (i) of Section 11.04.010 shall be solely for and in connection with aircraft carrying passengers. If an aircraft carries only freight, cargo and/or mail, the operations mentioned in the above subsection shall be performed only at aircraft parking space designated by the Director of Airports. The phrase "public aircraft parking space" shall be construed only to be the area clearly marked within the Metropolitan Airport terminal apron space.

§ 11.20.020. Common Use Gate.

Each user of the common use gate positions shall coordinate his or her use in such a way as to minimize interference with other users of that position. The Director may permit aircraft other than scheduled airlines to use common use gates.

§ 11.20.030. Preferential Use Gate.

Preferential gate positions shall not be used by other aircraft without prior permission of the Director of Airports, who will coordinate such use with the airline using the gate on a scheduled basis.

§ 11.20.040. Supervised Areas.

Any person, who is not an owner, or renter, or guest of either, who has an aircraft parked in a supervised area may be restricted from these areas for cause by the Airport Director.

§ 11.20.050. Sanitation.

Dogs and other domestic pets must be kept on a leash or kept in a vehicle or a container.

§ 11.20.060. Restricted Areas.

A person shall not enter upon the field area, utilities and service rooms or areas, or other restricted areas as defined in Section 11.04.010(m). A person is not allowed in these areas without prior permission of the Director of airports. After receiving permission the permittee must be accompanied in the area by a member of the Department of Airports, except for:

  1. Persons assigned to duty therein;

  2. Persons permitted by the Director;

  3. Passengers, under appropriate supervision, entering the apron for the purpose of enplaning and deplaning;

  4. Except that a person permitted to enter a supervised area as defined in Section 11.04.010(n) may traverse a taxiway in order to arrive at the supervised area.

§ 11.20.070. Concourse.

A person shall not throw paper, cigars, cigarettes, bottles or any other material from the observation balcony (concourse) or window or roofs of any buildings or structures on the airport.

§ 11.20.080. Passenger Fingers and Areas.

An airline operator or fixed based operator shall put back all gate chains and doors and other public safeguards under its control unless such gates, doors or safeguards are continually supervised or locked in a manner to protect all persons.

§ 11.20.090. Loitering and Refusal To Comply.

A person shall neither loiter nor loaf on any part of the airport or in any building on the airport. A person shall not come upon or use the airport, after having been refused the use of the airport by the Director except while traveling through as a passenger on or in a licensed common carrier transportation vehicle or while enplaning or deplaning as a passenger on an aircraft operating on the airport. Any person or persons who refuse to comply with the rules and regulations of the airport after proper request to do so by the Director is a trespasser.

§ 11.20.100. Use of Shop Areas.

The shops, garages, equipment and facilities on the airport are for the conduct of the owner's or lessee's business and operations. A person shall neither make use of these facilities nor loiter around such premises unless he or she has permission of the owner or lessee.

§ 11.20.105. Demonstration Policy at Sacramento County Airport System.

Authority is hereby delegated to the Director of the Sacramento County Airport System to issue and amend from time to time regulations relating to permits for noncommercial demonstration at the Sacramento International Airport, Executive Airport and Mather Airport. Any such regulations shall be reviewed and approved by the office of the County Counsel, and shall become effective 30 days after filing of such regulations with the Clerk of the Board of Supervisors.

§ 11.20.110. Conduct of Business or Commercial Activity.

A person shall neither engage in any business nor commercial activity of any nature whatsoever on the airport, including flight instruction and aircraft and engine repair, until such person has entered into a written contract and been issued a permit by the County. The following activities shall be permitted as defined below:

a. A person shall repair an aircraft, aircraft engine, propeller, or apparatus only in an area of the airport designated for such purpose by the Director. Minor adjustments may be done while the aircraft is on a loading ramp preparatory to taxi and takeoff when such adjustment is necessary to prevent a delayed departure;

b. An owner(s) of an aircraft(s) may perform repairs upon owned aircraft providing such individuals are permitted to do such work under current Federal Aviation Regulations; provided further that such work is conducted so as not to create any hazards or nuisance to other aircraft, persons or operator upon the airport. The work must be performed in an area approved by the Director. The approval will include without further designation those persons who may assist the owner as described in subsection c;

c. A person holding a current appropriate FAA certificate may assist an owner, instruct an owner, or supervise permitted work as defined in subsection b. This person will not be deemed an aviation operator in business on the airport which requires a contract with or permit from the County because he assists, instructs or supervises an owner who performs such permitted work;

d. A person holding a current FAA flight instruction license, who gives occasional flight instruction to an owner of an aircraft in the owner's aircraft, shall not be deemed an aviation operator in business on the airport requiring a contract with the County or a permit from the Director of Airports;

e. The Director may issue permits to individuals or companies to perform maintenance: on aircraft under unusual circumstances, i.e., repair to flyaway status, by owner of aircraft not based upon airports; on aircraft of unusual design, size or age; aircraft and the components for which there is not any qualified certificated operator upon the airport;

f. The registered owner of an aircraft is not prohibited from offering his or her aircraft for sale or from selling his or her aircraft;

g. A purchaser of goods or services from an aviation operator or permittee in business on the airport may freely do so without a permit, contract, or permission from the Airport Director;

h. An owner will not be prevented from performing a service for him or herself or from obtaining any service or labor from persons, other than aviation operators in business on the airport, when the owner is unable or unwilling to either obtain the needed service or goods on the airport involved or unable or unwilling to reach agreement with the available aviation operators on the airport.

A permit, issued by the Director of Airports, is required to be obtained by any person rendering services or labor to the aircraft owner as described in subsection h. The permit shall be obtained prior to performing any service or labor for the owner as described immediately above;

i. The permit as described in subsection h shall be issued by the Director of Airports under the following terms and conditions:

  1. The Airport Director shall determine what fee, if any, shall be charged for the issuance of said permit and shall determine what amount of insurance shall be required to be carried by the permittee. The permit may be issued on an annual basis or for a single entry by the permittee onto the airport.

  2. The Airport Director may not refuse to issue a permit as described above to any person described in subsection h except under the following circumstances: if the person applying for the permit is in violation of any provision of this title or has been excluded from the airport for cause under any applicable section of this title at the time the person makes application for a permit; if space is not available for the intended work; and if the proposed activity will cause a hazard by the nature of its operation and its location to other users of the airport.

§ 11.20.115. Permits for Nonexclusive Operating Rights and the Use of Real Property.

a. The Director is authorized on behalf and in the name of the County of Sacramento, to issue, reissue, suspend, revoke or terminate permits for nonexclusive operating rights at the Airport and/or for the use of real property at the Airport subject to the following limitations:

  1. The actual monthly rental for the use of real property which is the subject of the permit shall not exceed $1,000;

  2. The permittee shall pay the rates and charges established by the Board of Supervisors for any operating right;

  3. The term of the permit shall not exceed the period of 90 days;

  4. The permit shall be subject to immediate suspension and/or revocation where the permittee is in violation of the terms and conditions of the permit or any rule or regulation pertaining to the airport, including any provision of this title.

b. The Director shall determine what administrative fee shall be charged to issue or reissue a permit under this section, and shall determine what amount of insurance shall be required to be carried by the permittee.

c. The Director is further authorized to include in any permit issued under this section provisions which protect the County and the public health, safety, and welfare in the conduct of permittee operations and uses at the Airport.

d. The form of all permits issued by the Director shall have been approved by the County Counsel.

§ 11.20.120. Open Flame Operations.

A person shall neither conduct any open flame operations in any building nor have an open fire outside of a building on the airport until the Director has issued a permit.

§ 11.20.130. Smoking.

A person shall neither smoke on the airport apron, within 50 feet of any fueling or defueling operation, nor in any building, room or area on the airport where smoking is prohibited by the Director. Appropriate signs shall be installed by the Director giving notice of this provision.

§ 11.20.140. Trash Containers.

A person shall use only covered trash containers in any area. A vehicle used for hauling trash, dirt, or any other materials shall be operated on the airport only when the vehicle is constructed to prevent its contents from dropping, sifting, leaking, or otherwise escaping therefrom. Areas to be used for trash or garbage containers shall be designated by the Director. Such areas shall be kept clean and sanitary at all times.

§ 11.20.150. Apron and Floor Surfaces.

a. Each lessee or concessionaire on the airport shall keep the floors of the hangar areas and terminal apron and ramp areas, leased by them, or used in their operations, clean and free of oil, grease and other materials or stains which would cause a fire hazard or a slippery or unsafe condition.

b. A person shall not use any material (such as oil absorbents or similar material) that creates an eye hazard when picked up, swirled or blown about by the blast of air from an aircraft engine in any passenger loading area or other public area.

§ 11.20.160. Storage of Equipment.

A lessee or concessionaire on the airport shall store or stack material or equipment in such a manner as to prevent being a hazard to personnel or property.

§ 11.20.170. Equipment and Miscellaneous in Apron Area.

Ramp equipment shall be parked or stored in designated area, and kept in a neat and orderly manner. Receptacles, chests, cases or housing shall not remain on the apron or ramp area unless the Director has issued a permit.

§ 11.20.180. Fire Equipment.

Each lessee, licensee or concessionaire shall supply and maintain adequate and readily accessible fire extinguishers, as are approved by the National Board of Fire Underwriters, for its particular area, occupancy and hazards. The director may designate the location of the extinguishers.

§ 11.20.190. Structural and Decorative Changes.

Lessees or concessionaires shall make structural or decorative changes only with prior written permission of the airport director.

§ 11.20.200. Signs, Posters and Stickers.

A person shall post, distribute or display a sign, poster, sticker, advertisement, circular or other written or printed matter on the airport premises or airport buildings or structures only with the prior written permission of the airport director. For sale signs may be placed in aircraft on the airport. The signs are limited to a rectangular size of eight inches by eleven inches. If the airport director decides that any for sale sign in an airplane creates a hazard to the other airport users, the Director may order the sign removed.

§ 11.20.210. Commercial Photography.

A person may take a still, motion or sound picture on the airport for commercial or business purposes only with the written permission of the Director except for the following purposes: to provide news coverage of events on the airport; or to stimulate interest in air commerce or travel; or for nonprofit or personal purposes.

§ 11.20.220. Games.

A person shall not prepare to operate or release a kite, parachute, balloon, model aircraft or rocket or practice or play football, baseball, golf, tennis, bandy, hockey, shinney or any other game on the airport in which a ball, stone or other substance is thrown, struck, flown in the air or otherwise propelled, except during a period of time and in an area designated by the Director.

§ 11.20.230. Impersonation.

A person, except a member of the County Department of Airports shall not:

  1. Represent himself as a member of such Department;

  2. Assume or exercise the functions, powers, duties or privileges of a member of such Department;

  3. Wear or have in his possession a badge, uniform or other insignia that is, or purports to be, a badge, uniform or other insignia worn by a member of the Department.

§ 11.20.240. Bulletin Boards.

Each lessee of a hangar or other operational area, as specified by the Director, on the airport shall maintain a bulletin board in a conspicuous place in his hangar or area. The lessee shall post on that board a list of licensed physicians, a list of police and fire crash members and a copy of rules and regulations of the airport.

§ 11.20.250. Implementation.

The Director of Airports and the Board of Supervisors of the County may adopt any and all rules and regulations which they deem appropriate and necessary in order to implement the provisions and intent of this title.

§ 11.20.260. Notice of Violation.

The Director of Airports shall give written notice to any person in violation of the provisions of this title. The notice shall specify the specific section of the title being violated by the person. The notice shall also direct the person to either refrain from doing the act which constitutes a violation of this title or direct the person to do some affirmative act which shall cause compliance with the provisions of the title being violated.

§ 11.20.270. Appeals.

Any person who is dissatisfied with a decision made by the airport director under the terms of this title may appeal the decision to the Board of supervisors. At the hearing, the Board of Supervisors shall review the decision of the airport director and determine whether or not the decision of the airport director was correct and reasonable in light of the facts of the given situation.
