2.20.010 - Statutory authority—Findings.

The City Council finds that the appointment of a Planning Commission in accordance with the provisions of Sections 65, 150 of the Government Code of the State of California is necessary and desirable for the purpose of regulating the use of land in the City in order to preserve the physical environment and the human needs of the residents and the owners of land in the City; and the City Council further finds:

A. The Planning Commission shall consider all matters presented to it fairly and impartially, recognizing the rights of the applicant as well as its obligation to enforce all zoning ordinances and resolutions adopted by the City Council.

B. The development and use of all land within the City should be directed to the continuation of the existing rural open areas surrounding the existing residences in the City, and each new improvement or use of land should be carefully examined to determine what effect the proposed improvement or use of land will have on the terrain, trees and natural flora in the City.

C. The granting of variances and conditional use permits shall be carefully scrutinized to protect bridle trails and provide the proper spacing of residences and accessory buildings so as to prevent overconstruction of the lot or parcel to be improved.

2.20.020 - Appointment of members, terms of office and selection.

The Planning Commission shall consist of five members who shall be residents of the City, appointed by vote of not fewer than three members of the City Council. The term of office of the members of the Planning Commission shall be for staggered terms of four years. Following expiration of the term of office, each Commissioner shall serve until a successor is appointed and qualified.

2.20.025 - Residency requirement.

Each member of the Planning Commission shall be a resident of the City.

2.20.030 - Meeting time.

The Planning Commission will meet at the times and places established by resolution of the Planning Commission. The Planning Commission must meet at least once per month, unless its agenda contains no items of business within the Commission's jurisdiction under this chapter. If there are no items of business within the Commission's jurisdiction on the posted agenda, the Commission will not meet and the meeting may be adjourned by the City Clerk, or his or her designee, to the next regular meeting date. The Planning Commission will meet in the City Administration Building (City Hall), No. 2 Portuguese Bend Road, unless otherwise noticed in accordance with State law.

2.20.040 - Compensation.

Members of the Planning Commission do not receive compensation for attendance at Commission meetings.

2.20.050 - Quorum.

Three members of the Commission constitute a quorum for the transaction of business.

2.20.060 - Chairman—Vice Chairman—Secretary—Election and appointment.

The Commission shall elect a Chairman and Vice Chairman from among its members, who shall serve for a term of one year and until the successor of each is appointed. The Commission shall appoint a Secretary, who need not be a member of the Commission.

2.20.070 - Chairman—Vice Chairman—Secretary—Duties.

A. The Chairman shall preside at all meetings of the Commission, and he shall appoint all committees and shall perform all the duties necessary or incidental to his office.

B. The Vice Chairman is Chairman in the absence or inability of the Chairman to act.

C. The Secretary shall keep the minutes of each meeting and shall record each hearing and official action. On all official actions upon which a vote is taken, the Secretary shall take the vote by roll-call vote in alphabetical order, and with the Chairman voting last. The Secretary shall examine incoming mail for proper referral and shall answer correspondence for the Commission. The Secretary shall maintain records of operations and shall perform such other duties as the Commission may assign.

2.20.080 - Rules of business—Public recordkeeping.

The Commission shall adopt rules for the transaction of its business and shall keep a public record of its resolutions, transactions, findings and determinations.

2.20.090 - Removals—Vacancies.

A. A member of the Commission may be removed by a majority vote of the Council. A vacancy is filled in the same manner as the original appointment. A person appointed to fill a vacancy serves for the remainder of the unexpired term.

B. If a member of the Commission is absent for five meetings in any twelve-month period, the office becomes vacant automatically. The Commission shall immediately notify the City Council of the vacancy.

2.20.100 - Additional duties.

In addition to the duties, rights and powers imposed by State law, the Commission shall perform the duties and have the rights and powers and privileges provided by ordinance and resolution of the City Council.
