2.40.010 - Adoption of personnel system.¶
In order to establish an equitable and uniform system for dealing with personnel matters, and to comply with applicable laws and procedures relating to the administration of such personnel matters, a personnel system is adopted as provided in this chapter.

2.40.020 - Adoption of implementing personnel rules and policies.¶
The city council may by resolution adopt personnel rules to implement and govern the personnel system as well as related personnel policies. The city manager will cause the personnel rules and policies to be reviewed from time to time and recommend updates to the rules and policies as necessary or required by law. The council will conduct a public hearing prior to the adoption of or amendment to the personnel rules or policies.

2.40.030 - Definitions.¶
Unless defined in this chapter, the terms used to administer the personnel system are defined in the personnel rules.

2.40.040 - Applicability to competitive service and excluded service.¶
The provisions of this chapter apply to all offices, positions and employment in the service of the city (i.e., the "competitive service") except those listed below (the "excluded service"); provided, however, that such persons may still be subject to certain provisions of the city's personnel rules and personnel policies:
A. Elective officers;
B. The city manager, city clerk, city treasurer and city attorney;
C. Members of appointive boards, commissions and committees;
D. Persons engaged under contract to supply expert, professional, technical or any other services;
E. Emergency employees who are hired to meet the immediate requirements of an emergency condition, such as extraordinary fire, flood or earthquake which threatens life or property; and
F. Temporary employees.

2.40.050 - Administration.¶
The city manager will administer the city personnel system and may delegate any of the powers and duties to a human resources representative or may delegate the appointing authority granted by the city council to any other officer or employee of the city. The city manager will:
A. Act as the appointing authority for the city.
B. Administer all the provisions of this chapter and of the personnel rules and policies not specifically reserved to the city council.
C. Prepare and recommend to the city council personnel rules and policies and revisions and amendments to such rules and policies. The city attorney will approve such revisions as to form prior to their submission to the council.
D. Prepare or cause to be prepared a position classification plan, including class specifications, a comprehensive compensation plan, and a complete set of personnel policies. Such plans and policies, and any revisions, must be approved by resolution of the city council.
E. Have the authority to discipline employees in accordance with the personnel rules and policies.
F. Act as custodian of all personnel records and be the official upon whom all notices, requests for hearings, complaints and other official documents shall be served.
G. Maintain a roster of officials and employees of the city.
H. Prepare a record of the length of service of each employee and officer of the city together with a concise statement of the duties of each such officer and employee, together with the salary paid and hours rendered by the employee.
I. Contract for professional services in connection with the operation of the personnel system.
J. Perform any other duty that may be required to administer the personnel system.

2.40.060 - Basic salary plan.¶
The council will adopt, by resolution, a basic salary plan for all officers and employees of the city, except for elective positions. Such salary plan may, from time to time, be amended as required by the public interest.

2.40.070 - Retirement.¶
A contract is authorized between the city and the Board of Administration of the California Public Employees' Retirement System (CalPERS) to provide retirement benefits for employees of the city.
