2.16.010 - Establishment of department of public safety.

There is established within the city a department of public safety which shall include the fire department and the police department of the city.

2.16.020 - Director of public safety.

A director of public safety shall be in charge of the department of public safety. The director shall be appointed by the city manager subject to the approval of the city council. The director shall serve at the pleasure of the city manager and may be removed by the city manager subject to the approval of the city council.

2.16.030 - Duties of director.

The director of public safety shall be responsible for the proper maintenance and operation of the police department and the fire department. The director of public safety shall appoint a fire chief and a chief of police subject to the approval of the city manager and the city council. The director of public safety may also hold the office of police chief and fire chief.

2.16.040 - Supervision of city manager.

The director of public safety shall operate under the direct supervision of the city manager and in carrying out his function as the director of public safety, the director shall serve as a duly authorized representative of the city manager.

2.16.050 - Fire department.

A. The fire chief shall be responsible for the operation of the fire department and branches thereof.

B. Subject to the approval of the city manager or his duly authorized representative, the fire chief shall make appointments to department officer positions approved by the city manager and authorized by the city council.

C. All fire department officers shall serve at the pleasure of the fire chief and may be removed from office, good cause being shown therefor, by the fire chief with the consent and approval of the city manager or his duly authorized representative.

D. Subject to the approval of the city manager, the fire department may adopt bylaws, operating rules and regulations not inconsistent with this chapter or the best interests of the city.

2.16.060 - Volunteer fire auxiliary.

A. There is established the Rohnert Park volunteer fire auxiliary, herein referred to as the fire auxiliary. The fire auxiliary shall be supervised by the fire chief and other officers of the fire department. The Rohnert Park fire auxiliary shall be a branch of the fire department and as such shall be a governmental function of the city and shall be under the direct control of the city manager or his duly authorized representative.

B. Appointment of personnel into the fire auxiliary shall be made by the fire chief subject to the consent and approval of the city manager or his duly authorized representative.

2.16.070 - Police department.

A. The police chief shall be responsible for the operation of the police department and all branches thereof.

B. Subject to the approval of the city manager or his duly authorized representative, the police chief shall make appointments to department officer positions approved by the city manager and authorized by the city council.

C. All police department officers shall serve at the pleasure of the police chief and may be removed from office, good cause being shown therefor, by the police chief with the consent and approval of the city manager or his duly authorized representative.

D. Subject to the approval of the city manager, the police department may adopt bylaws, operating rules and regulations not inconsistent with this chapter or the best interests of the city.

2.16.080 - Volunteer police auxiliary.

A. There is established the Rohnert Park auxiliary police reserve, herein referred to as the police auxiliary. The police auxiliary shall be supervised by the director of public safety and other officers of the police department. The police auxiliary shall be a branch of the police department and as such shall be a governmental function of the city and shall be under the direct control of the city manager or his or her duly authorized representative.

B. Appointment of personnel into the police auxiliary shall be made by the director of public safety subject to the consent and approval of the city manager or his or her duly authorized representative.

C. The police auxiliary may consist of designated level one and nondesignated level one, two, and three reserves. Designated level one reserves shall have full peace officer powers, as defined in CA Penal Code Section 830.1.
