8.28.010 - Explosives defined.

For the purposes of this chapter, explosives are defined as set forth in California Health and Safety Code Section 12000, as amended from time to time.

8.28.020 - Issuing authority.

The police chief is designated the issuing authority under Section 12007 of the Health and Safety Code.

8.28.030 - Permit required.

It is unlawful for any person to deliver, store, handle or use any high explosives within the territorial limits of the city without having first applied for and received a city permit from the police chief or designee.

8.28.040 - Issuance of permit; discretion of police chief to condition or deny.

The police chief, or designee, shall, in the exercise of reasonable discretion, deny a permit to any person if it is his or her opinion that the delivery, handling or use of explosives by such person would be hazardous to property or dangerous to any person. The police chief may impose conditions on a permit which he or she finds reasonable to promote safety to property and persons.

8.28.050 - Security; amount; discretion of police chief.

A. All explosives permit applications must include evidence of financial responsibility to cover potential damage claims in the form of a public liability insurance policy or other financial security in a form acceptable to the State Fire Marshall and city attorney.

B. The amount of the security shall be a minimum of one million dollars, up to a maximum of five million dollars, as determined by the police chief in his or her sole discretion, based on assessment of potential harm to surrounding properties.
