3.16.200 - Purpose.¶
In order to implement the goals and objectives of the transportation element of the city of Rocklin General Plan, and to mitigate the traffic impacts caused by new development in the city, certain street improvements must be or had to be constructed. The city council has determined that a development impact fee is needed in order to finance these public improvements and to pay for development's fair share of the construction costs of these improvements. In establishing the fee described in the following sections, the city council has found the fee to be consistent with its General Plan and, pursuant to Government Code Section 65913.2, has considered the effects of the fee with respect to the city's housing needs as established in the housing element of the General Plan.

3.16.210 - Traffic impact fee.¶
A traffic impact fee is hereby established on issuance of all building permits for development in the city to pay for street improvements. The city council shall, in a council resolution, set forth the specific amount of the fee, describe the specific types of development and the benefit and impact area on which the impact fee is imposed, list the specific street improvements to be financed, describe the estimated cost of these improvements, describe the reasonable relationship between this fee and the various types of development, and set forth time for payment. As described in the fee resolution, this impact fee shall be paid prior to issuance of building permits. On an annual basis, the city council shall review this fee to determine whether the fee amounts are reasonably related to the impacts of development and whether the described street improvements are still needed.

3.16.220 - Limited use of fees.¶
The revenues raised by payment of this fee shall be placed in a separate and special account and such revenues, along with any interest earnings on that account, shall be used solely to:
A. Pay for the cost, including administrative costs, of future construction of street improvements described in the resolution enacted pursuant to Section 3.16.210 of this chapter, or to reimburse the city for those described or listed street improvements constructed in whole or in part by the city with funds advanced by the city from other sources; or
B. Reimburse developers who have been required or permitted by Section 3.16.230 of this chapter to install such street improvements which are oversized with supplemental size, length or capacity.

3.16.230 - Developer construction of facilities.¶
Whenever a developer is required, as a condition of approval of a development permit, to construct a street improvement described in a resolution adopted pursuant to Section 3.16.210 of this chapter, which improvements are determined by the city to have supplemental size, length or capacity over that needed for the impacts of that development, and when such construction is necessary to ensure efficient and timely construction of the street improvement network, a reimbursement agreement with the developer and/or a credit against all or a portion of the fee which would otherwise be charged pursuant to this chapter on the development project may be offered. The reimbursement amount shall not include the portion of the improvements needed to provide services to, or mitigate the need for street improvements created by the development, nor shall the developer be relieved from the obligation to pay that portion of the fee needed to mitigate impacts created by the development on the street system elsewhere in the city.

3.16.240 - Exemption from payment of traffic circulation surcharge and traffic signalization fee.¶
No traffic circulation surcharge under Article II of this chapter and no traffic signalization fee under Article III of this chapter shall be due or collected upon the application for or issuance of any building permit for which a traffic impact fee is imposed and paid under this article.
