16.04.010 - Title.

The ordinance codified in this title is adopted to supplement and implement the Subdivision Map Act set forth in Division 2, Title 7 of the Government Code of the state and may be cited as the subdivision ordinance of the city.

16.04.020 - Purpose.

A. The council of the city has, in the interest of protecting the health, safety, and general welfare of the people of the city, adopted the ordinance codified in this chapter to carry out the following purposes:

  1. To implement the provisions of the Subdivision Map Act (Title 7, Division 2, Government Code);

  2. To provide policies, standards, requirements, and procedures to regulate and control the design and improvement of all subdivisions within the city;

  3. To implement the programs, policies and objectives of the general plan;

  4. To direct the growth of the city and to preserve the essential characteristics of the city.

B. In support of those purposes there shall be the maximum practical retention of desirable environmental and ecological features of the terrain; trees and vegetation shall be retained or replaced and natural waterways and watercourses shall be preserved in their natural state.

C. It is also intended that there shall be a minimum disturbance and alteration of the natural topography. Development shall be fitted to the topography rather than the terrain altered to fit the development. Grading of land shall be kept to a minimum; streets should generally follow land contours with rectilinear block layouts discouraged.

D. An imaginative approach in the design of subdivisions and the siting of structures on parcels is encouraged rather than a monotonous, unimaginative approach to meet minimum requirements.

16.04.030 - Conformity with other ordinances.

Neither the approval nor conditional approval of a subdivision map pursuant to this title shall constitute or waive compliance with any other applicable provision of any ordinance of the city or other regulation adopted by the city, nor shall any such approval authorize or be deemed to authorize a violation or failure to comply with other applicable ordinances of the city. Nothing in this title shall be construed to permit the premature or haphazard subdivision of land in derogation of Title 17 or the general plan as the same relate to open space.
