16.09.010 - Reference to Housing Code.

This chapter shall be known as the "Housing Code" and may be cited as such. Whenever in this Code or any ordinance of the City the phrases "Uniform Housing Code" or "Housing Code" appear, such phrases shall be deemed and construed to refer or apply to this chapter in conjunction with Chapter 16.04.

16.09.020 - Uniform Housing Code adopted—Filed with Building Official.

The Uniform Housing Code, 1997 Edition, and any related errata, and any amendments thereto by the State of California in Title 25 of the California Code of Regulations, promulgated by the International Conference of Building Officials, which regulates the occupancy, equipment, use, height, area and maintenance of buildings and premises, is adopted and by this reference is made a part of this Code with the force and effect as though set out herein in full with the exception of those parts expressly excepted and deleted or as amended by this chapter. One copy of the Uniform Housing Code, which has been certified as a true copy, is on file and open to public inspection in the office of the Building Official.

16.09.030 - Section 203 deleted—Right of appeal.

203 and Chapter 12 of the Uniform Housing Code are excepted, deleted and not adopted. The administrative enforcement of this chapter is subject to the right of appeal to an Administrative Hearing Officer, pursuant to the procedures set forth in Section 16.04.550.

16.09.035 - Section 201.4 added—Deputies.

201 of the Uniform Housing Code is amended by adding thereto a new Section 201.4 to read as follows:

201.4 Deputies. In accordance with prescribed procedures and with the approval of the appointing authority, the Building Official may appoint such number of technical officers and inspectors and other employees as shall be authorized from time to time. The Building Official may deputize such inspectors or employees as may be necessary to carry out the provisions of the Uniform Housing Code.

16.09.080 - Section 1607 amended—Payment.

1607 of the Uniform Housing Code is amended to read as follows:

The City Council in its discretion may determine that assessment shall be payable in not to exceed five equal annual installments. The Council's determination to allow payment of such assessments in installments, the number of installments, whether they shall bear interest, and the rate thereof shall be by a resolution adopted prior to the confirmation of the assessment.

16.09.100 - Additional requirement—Caretaker—Notice.

In addition to the requirements of the Uniform Housing Code, the following shall be required:

A. Caretaker. A janitor, housekeeper or other responsible person shall reside upon the premises and shall have charge of every apartment house in which there are 16 or more apartments and of every hotel in which there are 12 or more guest rooms, in the event that the owner of any such apartment house or hotel does not reside upon the premises.

B. Notice. If the owner does not reside upon the premises of any apartment house in which there are more than four but less than 16 apartments, a notice stating the owner's name and address or telephone number, or the name and address or telephone number of his agent in charge of the apartment house, shall be posted in a conspicuous place on the premises.

16.09.110 - Enforcement.

In addition to any enforcement officer authorized to enforce the provisions of the Uniform Housing Code, City code enforcement officers and any health officer are hereby authorized to enforce the provisions of the Uniform Housing Code and specifically enforce for:

A. Infestation of insects, vermin, or rodents.

B. Any visible mold growth, excluding the presence of mold that is minor and found on surfaces that can accumulate moisture as part of their property function and intended use.
