1.05.010 - Authority.

This chapter is enacted pursuant to the City's authority under the Constitution and laws of the State of California, including but not limited to California Constitution Article XI, Sections 5, 7 and 9, and Section 935.

1.05.020 - Claims required.

All claims against the City for money or damages not otherwise governed by the Tort Claims Act, California Government Code §§ 900 et seq., or another state law, (hereinafter in this chapter, "claims") shall be presented within the time, and in the manner, prescribed by Part 3 of Division 3.6 of Title 1 of the California Government Code (commencing with § 900 thereof) for the claims to which that Part applies by its own terms, as those provisions now exist or shall hereafter be amended, and as further provided by this chapter.

1.05.030 - Form of claim.

All claims shall be made in writing and verified by the claimant or by his or her guardian, conservator, executor or administrator. In addition, all claims shall contain the information required by California Government Code § 910. The foregoing reference to Government Code § 910 shall not be construed to authorize a class claim or a representative claim, and no claim may be filed on behalf of another person or a class of persons unless verified by such other person(s) and each member of any purported class. This section clarifies the intent of the existing ordinance and is therefore declaratory of existing law.

1.05.035 - Electronic service of government claims and notices.

Pursuant to California Government Code § 915, a claim, any amendment thereto, or an application for leave to present a late claim, may be submitted in person, by mail, or electronically to the City Clerk by using the online claim form available on the City's webpage at https://www.riversideca.gov/claims, in accordance with all publicly posted instructions. The City Manager is authorized to provide uniform instructions for the filing of claims electronically that are not in conflict with Division 3.6 of Title 1 of the Government Code or this section.

Proof of electronic service may be made and signed in the manner prescribed by California Government Code § 915.2, as it may be amended from time to time. If the claim or application is submitted electronically, the person or party shall be deemed to have provided consent to accept service electronically of the notices specified in Government Code § 915.4, as may be amended from time to time, and other correspondence from the City of Riverside or its representatives.

1.05.040 - Claim prerequisite to suit.

In accordance with California Government Code §§ 935(b) and 945.6, all claims shall be presented as provided in this chapter and acted upon in accordance with Chapter 1.06, and no action may be maintained by a person or public agency who has not complied with the requirements of this chapter.

1.05.050 - Suit.

Any action brought against the City of Riverside upon any claim or demand shall conform to the requirements of California Government Code §§ 940-949. Any action brought against any employee or former employee of the City of Riverside shall conform with the requirements of California Government Code §§ 950—951.
