Richmond Municipal Code Ch. 12.32 Maintenance of Pipes, Mains, Conduits and Car Tracks

12.32.010 - Moving pipes, mains, etc. likely to interfere with improvement.

Whenever any pipe, main, conduit or car track in or upon any public street in the city of Richmond is situated or located so as to interfere with, impede or prevent the performance of any public work or improvement in or upon such street, or whenever any such pipe or main used for the carrying or transmission of water is so situated or located that it is likely to become broken, crushed or damaged in the performance of any such public work or improvement the person owning, operating or maintaining such pipe, main, conduit or car track shall upon written notice, in the form as hereinafter provided in Section 12.32.040, from the superintendent of streets of the city of Richmond lower, raise or otherwise move such pipe, main, conduit or car track so that the same shall not so interfere with or be so damaged by such public work or improvement.

12.32.020 - Removal and replacement of water pipes likely to damage improvement.

Whenever any existing pipe line or main or portion thereof used for the carrying or transmission of water in any public street in the City of Richmond being improved or about to be improved as aforesaid is found by the superintendent of streets to be deteriorated to such extent that it is leaking or likely to leak and therefore likely to injure and damage any pavement, base or subgrade being constructed or about to be constructed in or upon such street, the person owning, operating or maintaining such pipe or main shall upon written notice in the form hereinafter provided in Section 12.32.040 from the superintendent of streets remove such deteriorated pipe and replace it with new pipe.

12.32.030 - Removal and replacement of water pipes likely to damage existing pavement.

Whenever any existing pipe or main or portion thereof used for the carrying or transmission of water in any paved public street in the City of Richmond has deteriorated to such an extent that by reason of leakage of water therefrom the pavement, base or subgrade of such street is being damaged, the person owning, operating or maintaining such pipe or main shall, upon written notice in the form as hereinafter provided in Section 12.32.040 from the superintendent of streets, remove such deteriorated pipe and replace it with new pipe.

12.32.040 - Notice to alter.

Whenever it becomes necessary for any of the reasons hereinabove set forth to require the lowering, raising or otherwise moving of any pipe, main, conduit or car track or to require the removal and replacing of any existing pipe or main used for the carrying or transmission of water, the superintendent of streets shall give written notice to the person owning, operating or maintaining the same to forthwith at his own cost and expense and in the manner prescribed and set forth in such notice, raise, lower or otherwise move such pipe, main, conduit or car track or remove and replace such pipe or main used for the carrying or transmission of water; and the person so notified as aforesaid shall within twenty-four hours after the receipt of such notice commence the work required thereby to be done and shall continue and complete such work without delay and within the time specified in the notice by the superintendent of streets.

12.32.050 - Work to be done without delay.

In the event any such pipe, main, conduit or car track so required to be raised, lowered or otherwise moved or any such pipe or main so required to be removed and replaced is being used by any person for furnishing water, gas, electric light, heat or power, transportation or other service to the general public such person shall conduct said required work in such manner as to not unnecessarily delay said public service.

12.32.060 - Service of notice.

Any notice provided in this chapter to be given may be served in the same manner that a summons is required to be served in any civil action under the laws of the State of California.
