Richmond Municipal Code Ch. 12.66 Water Well Standards

12.66.010 - Title.

This chapter shall be known as the "Water Well Standards Ordinance," may be referred to as such, and shall be referred to herein as "this chapter."

12.66.020 - Purpose.

(a) It is the intent of the Council for the City of Richmond in adopting this chapter to provide a method for monitoring and maintaining standards for the construction, repair and destruction of water wells, cathodic protection wells and monitoring wells, so as to protect the health, safety and general welfare of the people of the City of Richmond and surrounding communities by ensuring that the groundwater will not be contaminated or polluted.

(b) It is also the intent of the Council of the City of Richmond in adopting this chapter to comply with the requirements of California Water Code Section 13801.

12.66.030 - Adoption by reference.

The following portions of Chapter 414-4 of the Ordinance Code of Contra Costa County, Approved Water Supply Systems, are adopted by reference as though fully set forth herein:

(a) Article 414-4.2: Section 414-4.202, insofar as it relates to wells, and the definitions contained in Sections 414-4.203, 414-4.215, 414-4.231, 414-4.233, 414-4.235 and 414-4.239;

(b) Article 414-4.8, in its entirety;

(c) Article 414.10: Section 414-4.1001, subsections (b) and (c) only; and Sections 414-4.1003, 414-4.1005, 414-4.1007, 414-4.1009, 414-4.1011, 414-4.1013, 414-4.1015, 414-4.1017, 414-4.1019, 414-4.1021 and 414-4.1023; and

(d) Article 414-4.12: Section 414-4.1201, insofar as it relates to wells, and Section 414-4.1205.

12.66.040 - Administration and enforcement.

The Health Officer of Contra Costa County Health Services Department, his/her medical deputies, his/her Environmental Health Inspectors or his/her other duly authorized representatives shall, on behalf of the city, administer and enforce those sections of Chapter 414-4 of the Ordinance Code of Contra Costa County, Approved Water Supply Systems, which are adopted by reference by this chapter. In the course of administering and enforcing this chapter, the county of Contra Costa shall be entitled to collect and retain all permit fees, costs of abatement, appeal hearing fees and any other fees and costs which are authorized by this chapter.

12.66.050 - Prior city approval required.

Notwithstanding any other provision of this chapter, the Health Officer of the Contra Costa Health Services Department shall not accept any application for nor issue any permit required by this chapter without the prior approval of the City of Richmond Public Works Department and the Planning Department of the location, nature and type of well proposed. The City of Richmond Public Works Department and the Planning Department shall adopt such regulations as are necessary to govern the location, nature and type of wells which may be approved and for which permits may be issued by the Health Officer of the Contra Costa Health Services Department pursuant to this chapter.
