Editor's note— Ord. No. 09-22 N.S., § 1, adopted June 28, 2022, amended the Code by repealing Ch. 12.30, §§ 12.30.010—12.30.090, and adding a new Ch. 12.30. Former Ch. 12.30 pertained to video service provider, utility and special district encroachments, and derived from Ord. No. 21-08 N.S.

12.30.010 - Purpose.

The public rights-of-way are unique, physically limited public resources held in trust for the public's benefit, and they require proper management to maximize their efficiency and minimize the taxpayers' costs; to protect against foreclosure of future economic expansion due to premature exhaustion of these resources; and to minimize the inconvenience to, and negative effects on, the public from use of these rights-of-way by individuals, contractors, utility companies, video service providers, utilities, special districts, et al.

To achieve this chapter's purpose, the City shall endeavor to coordinate its capital improvement programs with those of utility companies and franchisees with facilities in, on, under, or above the public rights-of-way. Information about planned work in the right-of-way shall be communicated as early in the process as possible. Utility owners and franchisees should strive to coordinate street excavations to allow for simultaneous work and to prevent a street from multiple excavations within a 12-month period.
