8.08.010 - Definitions.

The word INCINERATOR means any device used for the destruction of refuse, rubbish or leavings by fire.

(b) The words COMMERCIAL INCINERATOR shall be deemed to mean any incinerator other than that used on premises consisting of three or less dwelling units for the destruction of rubbish, refuse or leavings accumulated from such dwelling units.

(c) The word PERSON shall mean and include individuals as well as associations of any kind, corporations, firms, partnerships and trusts.

8.08.020 - Permit required.

No person shall construct or erect, or cause to be constructed or erected, any commercial incinerator within the City of Richmond without first obtaining a building permit therefor from the Building Inspector of the City of Richmond, provided, however, that the Building Inspector shall not issue a permit until a license to operate and maintain such commercial incinerator has been granted by the Fire Marshal as herein provided.

8.08.030 - License required.

No person shall operate or maintain, or cause to be operated or maintained, any commercial incinerator within the City of Richmond without first obtaining a license so to do from the Fire Marshal of the City of Richmond.

8.08.040 - Application for permit and license.

Any person desiring a permit to construct or erect a commercial incinerator as required by this chapter and/or a license to operate or maintain a commercial incinerator as required by this chapter shall file with the Building Inspector an application therefor in writing on a form to be furnished for that purpose. Every such application shall contain the following:

(a) The location of the incinerator or proposed incinerator.

(b) The type and specifications of the incinerator.

(c) The material or materials to be burned in incinerator.

(d) The hours which the incinerator is to be operated.

(e) The extent to which the incinerator will emit smoke, fumes, noxious odors, dust, ashes or other substances.

8.08.050 - Application fees.

Any person applying for a license to operate or maintain a commercial incinerator as required by this chapter shall, at the time of filing such application, pay to the Building Inspector a fee of two dollars. Every license issued pursuant to this chapter shall be valid until the 30th day of June following the date of issuance. Thereafter, licenses to operate or maintain a commercial incinerator may be renewed from year to year on payment of a renewal fee of one dollar.

8.08.060 - Denial of licenses.

The Fire Marshal shall not issue any license to operate or maintain any commercial incinerator in any instance where the operation or maintenance of the incinerator for which a license is sought is likely to create a nuisance by reason of emitting smoke, fumes, noxious odors, dust, ashes or other materials.

8.08.070 - Denial of permits.

The Building Inspector shall not issue any building permit for the construction or erection of any commercial incinerator in any instance where, in the opinion of the Building Inspector, the incinerator proposed to be constructed is likely to create a nuisance by reason of emitting smoke, fumes, noxious odors, dust, ashes or other materials.

8.08.080 - Revocation of licenses.

Whenever, in the opinion of the Fire Marshal, any incinerator is operated or maintained in a manner to create a nuisance by reason of the emission from such incinerator of smoke, fumes, noxious odors, dust, ashes, or other materials, the Fire Marshal shall forthwith cancel and withdraw any license which may heretofore have been issued pursuant to this chapter for the operation or maintenance of such incinerator.

8.08.090 - Appeals.

Any person may appeal any decision or action of the Fire Marshal or the Building Inspector pursuant to this chapter to the Council of the City of Richmond, whose findings upon such appeal shall be conclusive.
