7.98.010 - Purpose.

The purpose of this chapter is to require each owner of each retail gasoline service station in the city of Richmond to dispense gasoline and post signs and flags as hereinafter provided in this chapter in furtherance of the public safety and welfare and traffic control in this city.

7.98.020 - Odd-even gasoline sales plan.

(a) It shall be unlawful to dispense gasoline from any retail gasoline service station in this city into any vehicle except as hereinafter provided:

(1) Gasoline may be dispensed into vehicles with a license plate whose last or only digit is an odd number only on the odd-numbered days of the month. Environmental license plates that contain only letters shall be considered as an odd number.

(2) Gasoline may be dispensed into vehicles with a license plate whose last or only digit is an even number only on the even-numbered days of the month. Vehicles without a permanent license plate, such as newly purchased vehicles, shall be considered as an even number.

(3) For any month in which there are 31 days, gasoline may be dispensed into vehicles on the 31st day of the month without regard to the license plate of such vehicles.

(b) The following vehicles shall be exempt from the restrictions in subsection (a) of this section:

(1) Emergency vehicles as defined in Section 165 of the California Vehicle Code.

(2) Other emergency repair and service vehicles, whether public or private, used for functions directly related to the protection of life, property, or public health.

(3) Vehicles operated in an unusual emergency situation in the judgment of the gasoline retailer.

(4) Motorcycles, mopeds, and similar two-wheel vehicles.

(5) Public transportation vehicles regularly used to transport passengers such as buses, taxis, and vehicles rented for less than 30 days.

(6) Vehicles used for commercial purposes in the judgment of the gasoline retailer.

(7) U. S. Postal Service vehicles.

(8) Vehicles operated by handicapped persons who have no practical alternative to auto transportation as designated by the following license plate letters:

(9) Any vehicle displaying a disabled person placard issued by the California Department of Motor Vehicles.

(10) Vehicles with out-of-state license plates.

7.98.030 - Signs keeping public posted on times of gasoline sales and prices.

(a) On each day when the owner of a retail gasoline service station in this city intends to sell gasoline to the motoring public, he shall, prior to commencing such sale, place a sign near each entrance to the station which, in letters not less than four inches high and one inch in width, shall keep the motoring public continuously posted on the times when such sale is to commence and to cease during that day and on the prices for each grade of gasoline.

(b) On each day when the owner of such a station does not intend to sell gasoline to the motoring public, he shall, prior to seven a.m., place a sign near each entrance to the station which, in the same type of lettering referred to in subsection (a) of this section, so informs the public. If during that day the owner changes such intention, the owner shall, before commencing the sale of gasoline, comply with the provisions of subsection (a) of this section.

7.98.040 - Posting of flags.

Each owner of a retail gasoline service station in this city shall indicate the gasoline supply and service station situation of said station by a flag of at least 18 inches square, easily visible from off the premises. The following shall apply:

Green Flag — Gasoline available for the general public (on appropriate days for appropriate license plates).

Yellow Flag — Gasoline available for emergency vehicles only and automobile servicing available to the general public.

Red Flag — Out of gasoline and/or closed. In addition, if a retailer is out of any grade of gasoline, but is otherwise still dispensing gasoline to the general public, the retailer shall indicate on a sign legible from off the premises which grades are not available.
