9.20.010 - Allowable burning.¶
No person shall ignite, set fire to or burn any rubbish, papers, shavings, boxes, grass, brush or other combustible materials except as follows:
A. In an approved type incinerator;
B. In an open fire authorized by the written permit from the fire chief or his/her duly authorized deputy, and provided further that a competent person or persons be in constant attendance at such burning until the fire is extinguished.

9.20.020 - Burning hours—Designated.¶
All burning regulated under this chapter shall be done between six a.m. and eleven a.m., except when such burning is done pursuant to a permit from the fire chief or his/her duly authorized deputy, or is done in an incinerator so constructed or located as to be a part of, or opening into, any building.

9.20.030 - Wind velocity.¶
No burning shall be conducted whenever a wind of over ten miles per hour is blowing from any direction.

9.20.040 - Burning hours—Exceptions.¶
The provisions of Section 9.20.020, pertaining to the hours of burning, shall not apply to any permanent outside grill or barbecue pit, provided that any fire therein shall be kept under competent and continuous supervision, and all inflammable and combustible material removed a sufficient distance from the grill or barbecue pit so as not to constitute a fire hazard; and provided further that all fire or coals in the grill or barbecue pit are thoroughly extinguished after the use thereof has been completed.

9.20.050 - Garbage burning.¶
It is unlawful to burn garbage within the city unless the burning is conducted in a gas-fired, sanitary incinerator within a building, having a stack sufficiently high to control all odors.

9.20.060 - Inspection of premises.¶
The fire chief or his/her duly authorized deputy may at any reasonable time enter upon any premises for the purpose of determining whether or not the provisions of this chapter have been complied with.

9.20.070 - Incinerator, grill, barbecue pit—Compliance required.¶
No incinerators, permanent outside grill or barbecue pit shall be constructed, located, installed, equipped, maintained or used within the city, unless it complies with the terms of this chapter.

9.20.080 - Incinerator, grill, barbecue pit—Nuisance abatement.¶
If the location of any incinerator, permanent outside grill or barbecue pit creates a public or private nuisance or fire hazard, the fire chief or his/her duly authorized deputy may order the person owning or using the incinerator, grill or barbecue pit to immediately cease the use thereof, and to move the same to a location approved by the fire chief or his/her duly authorized deputy.

9.20.090 - Prohibited uses of grills and barbecue pits.¶
No permanent outside grill or barbecue pit shall be used for the disposal or burning of combustible waste materials.

9.20.100 - Incinerator, grill, barbecue pit—Spark arrestors required.¶
Every incinerator and permanent outside grill shall be equipped and maintained with a spark arrestor approved by the fire chief or his/her duly authorized deputy.

9.20.110 - Incinerator, grill, barbecue pit—Maintenance.¶
Every incinerator, permanent outside grill, barbecue pit and the equipment thereof shall be maintained in good condition, working order, and repair at all times.

9.20.120 - Types of approved incinerators.¶
The following types of incinerators are approved:
A. An incinerator constructed of either concrete, brick, masonry, or number three gauge metal and a spark arrestor of heavy hardware cloth of eleven gauge half-inch mesh and secured at least four feet from all combustible substances;
B. An incinerator of the fifty gallon drum type construction shall be of not less than eighteen gauge U.S. metal, and set off the ground by means of noncombustible material. Top of drum to be provided with a spark arrestor of heavy hardware cloth of eleven gauge half-inch mesh, and installed on top of drum at all times during the burning of debris. This type of incinerator to be kept at least six feet from all combustible substances.
Any incinerator herein defined which in the opinion of the fire chief or his/her duly authorized deputy is unfit for further use shall not thereafter be used.
With respect to any incinerator presently installed and in use which subsequently does not meet the standards of this chapter, the replacement of such nonapproved incinerator may be deferred.

9.20.130 - Incinerator, grill, barbecue pit—Fire hazard prohibited.¶
No person shall construct, erect, install, locate, equip, maintain, or use any incinerator, permanent outside grill or barbecue pit, or so burn any combustible matter as to constitute or occasion a fire hazard by the use or burning thereof so as to endanger the life or property of any person thereby.

9.20.140 - Incinerator, grill, barbecue pit—Inspection.¶
The fire chief or his/her duly authorized deputy, may at any reasonable time enter upon any premises for the purpose of determining whether or not the provisions of this chapter have been complied with.
