§ 5-2.401. Definitions.¶
For the purposes of this article, unless otherwise apparent from the context, certain words and phrases used in this article are defined as follows:
"Person"
shall mean all domestic and foreign corporations, association, syndicates, joint stock companies, partnerships of every kind, joint ventures, clubs, Massachusetts business or common law trusts, societies, and individuals.

§ 5-2.402. Household hazardous waste collection fee imposed.¶
There is hereby imposed a fee upon every person occupying a residential dwelling unit utilizing residential refuse collection service in the City. The fee imposed by this section shall be at a rate which shall be set, from time to time, by resolution of the City Council, and shall be paid by the person paying for such refuse collection service. The fee established by this article shall be utilized to offset the costs of establishing, publicizing and maintaining a Household Hazardous Waste Collection Program.

§ 5-2.403. Fee collection.¶
(a) City residential refuse billings. For residential refuse collection services provided by the City, its contractor or franchisee, and billed by the City, the Household Hazardous Waste Collection Fee shall be billed and collected on behalf of the City through the office of the County Assessor and Tax Collector.
(b) Private residential refuse billings. For residential refuse connection services provided and billed by a private refuse hauler, the Household Hazardous Waste Collection Fee shall be collected by each hauler, from each person, in conjunction with the hauler's usual and customary billing procedure and schedule for each customer. The total amount of fees collected in each calendar month shall be remitted to the City Treasurer on or before the twentieth (20th) day of the following month.

§ 5-2.404. Penalties.¶
(a) Fees collected by a private refuse hauler from a service user which are not remitted to the City Treasurer on or before the due date provided in this article shall be delinquent.
(b) Penalties for delinquency in the remittance of any fee collected or any deficiency determination shall attach and be paid by the private refuse hauler required to collect and remit at the rate of 15% of the total fee collected or imposed by the provisions of this article.
(c) The City Treasurer shall have the power to impose additional penalties upon private haulers required to collect and remit fees pursuant to the provisions of this article for fraud or negligence in reporting or remitting at the rate of 15% of the amount of the fee collected or as recomputed by the City Treasurer.
(d) Every penalty imposed pursuant to the provisions of this section shall become part of the fee required to be remitted.

§ 5-2.405. Actions to collect.¶
Any fee required to be paid by a service user under the provisions of this article shall be deemed a debt owed by the service user to the City. Any such fee collected from a service user which has not been remitted to the City Treasurer shall be deemed a debt owed to the City by the person required to collect and remit. Any person owing money to the City under the provisions of this article shall be able to an action brought in the name of the City for the recovery of such amount.

§ 5-2.406. Records.¶
It shall be the duty of every private person required to collect and remit any fee imposed by this article to keep and preserve, for a period of three years, all records as may be necessary to determine the amount of such fee as he may have been liable for the collection and remittance to the City Treasurer, which records the City Treasurer shall have the right to inspect at all reasonable times.

§ 5-2.407. Enforcement.¶
The City Treasurer shall have the power and duty, and is hereby directed, to enforce each and all of the provisions of this article.

§ 5-2.408. Violations: Misdemeanors.¶
Any person violating any of the provisions of this article shall be guilty of a misdemeanor and shall be punishable as provided for in Section 1-2.01 of Title 1 of this Code.
