§ 5-2.301. Purpose and intent.

(a) The Council finds and determines as follows:

(1) That the business and commercial area on and adjacent to the Redondo Pier Area, including the Monstad Pier, the Municipal Pier, the Pier Approach, the International Boardwalk, and the Top Deck of the Pier Parking Structure, by reason of its geographical, topographical, and commercial character, constitutes a business district which is unique and different from all others within the City and that said area attracts to it large numbers of transients, visitors, and/or customers, thereby requiring special sweeping, cleaning, public rest room facilities, and other public services; and

(2) That in order to protect the public health, safety, and welfare, it is necessary to provide special and uniform services within that area described as the Redondo Pier Area in Section 4-9.801 of Article 8 of Chapter 9 of Title 4 of this Code.

(b) It is the purpose of this article to provide for a special cleaning fee assessment upon the business enterprises within said area to produce the revenue required for such special services within said area.

§ 5-2.302. Business licensee defined.

For the purposes of this article, "business licensee" shall mean an individual, group of individuals, or firm required to obtain a business license under the provisions of Chapter 1 of Title 6 of this Code.

§ 5-2.303. Assessment rates.

All business licensees operating or conducting businesses within the Redondo Pier Area shall pay a cleaning fee assessment to be fixed and established in accordance with a fee schedule set forth by resolution of the Council to reflect changes in the cost or providing cleaning services within said area.

§ 5-2.304. Collection of fees.

(a) The special cleaning fee assessment imposed upon all business licensees located within the Redondo Pier Area, as set forth in this article, shall be due and payable on a quarterly basis within 30 days after the date upon which such assessment is billed.

(b) Each business licensee shall make an application for the business license required in accordance with Chapter 1 of Title 6 of this Code. Upon the filing of such application and the payment of the required license tax and the first quarter's cleaning fee assessment, the License Clerk and Collector shall issue to the business licensee a business license.

(c) In the event a business licensee shall fail to pay the required quarterly cleaning fee as prescribed in this article, he shall be subject to the civil penalties provided for by this Code.

§ 5-2.305. Disposition of funds collected.

Upon the receipt of the cleaning assessment fees provided for in this section, the City Treasurer shall deposit such funds in the Redondo Pier Area Special District Fund to be used for the purposes set forth in this article.
