§ 4-9.1201. Definitions.

As used in this section the following terms shall have the meanings set forth herein.

"Aerosol paint containers"

means any container, regardless of the material from which it is made, which is adapted or made for the purpose of spraying paint or other similar substance capable of defacing property.

"Felt-tip marker" or "marking pen"

means any indelible marker or similar implement with a tip which, at its broadest width, is greater than one-eighth inch, containing any ink or dye substance.

"Graffiti"

means any inscription, word, figure, drawing, or design marked, etched, scratched, drawn or painted on any surface, accomplished without permission of the owner.

"Graffiti implement"

means any implement (whether commercial or home-made) capable of marking a surface to create graffiti, including, but not limited to aerosol paint containers, paint sticks, felt tip markers, or marking pens, marking instruments, drill bits, grinding stones, scribers, glass cutters, or etching tools, capable of scarring glass, metal, concrete or wood.

"Paint stick"

means a device containing a solid form of paint, wax, epoxy or other similar substance capable of being applied to a surface by pressure and, upon application leaves a visible mark.

"Responsibility for cost of graffiti removal"

means whenever graffiti has been removed from public or private property at the expense of the City, each person who placed any of the graffiti, and the custodial parents or guardians of any minor who placed any of the graffiti, shall be legally responsible to reimburse the City for all cost of removal.

"Spray activator," also known as a "spray tip" or "nozzle"

means an object which is capable of being attached to an aerosol paint container for the purpose of spraying the substance contained within.

§ 4-9.1202. Possession of graffiti tools.

It is unlawful for any minor under the age of 18 to possess any device, tool, engraving material, marker pen, or spray can tip capable of being used for the purpose of defacing property while on any public highway, street, alley, way, school, park, or other public place, regardless of whether that person is or is not in any automobile, vehicle, or other conveyance.
