12.54.010: DEFINITIONS:¶
A. For purposes of this chapter, "park" means any public park or portion of a public park, such as picnic areas, located within the city and includes any city owned recreational areas including, for example, the Redlands Bowl, the Avice Meeker Sewall Theater and the Redlands sports park.
B. For purposes of this chapter, "smoking" means inhaling, exhaling, burning or carrying any lighted cigar, cigarette, weed, plant or other combustible substance that is inhaled or exhaled in any form or manner.
C. For purposes of this chapter, "tobacco products" mean any substance containing tobacco leaf, including, but not limited to, cigarettes, cigars, pipe tobacco, snuff, chewing tobacco, dipping tobacco, bidis or any other preparation of tobacco. (Ord. 2546 § 1, 2003)
12.54.020: PUBLIC PARKS:¶
Except for those persons participating in an authorized performance at the Redlands Bowl or at the Avice Meeker Sewall Theater, smoking is prohibited within all public parks in the city. (Ord. 2546 § 1, 2003)
12.54.030: PUBLIC NOTICE:¶
"No smoking" or "smoke free" signs, with letters of no less than one inch (1") in height, or with the international "no smoking" symbol (consisting of a pictorial representation of a burning cigarette enclosed in a red circle with a bar across it), shall be clearly, sufficiently and conspicuously posted by the city in every public park in which smoking is prohibited by this chapter. Signage shall include the city phone number where complaints may be directed. (Ord. 2546 § 1, 2003)
12.54.040: DISPOSAL:¶
No person shall dispose of smoking waste or tobacco product waste within the boundaries of a public park except in a designated waste disposal container. (Ord. 2546 § 1, 2003)
12.54.050: REPRISAL:¶
No person shall intimidate, threaten any reprisal, or effect any reprisal, for the purpose of retaliating against another person who seeks to attain compliance with this chapter. (Ord. 2546 § 1, 2003)
12.54.060: ENFORCEMENT AND PENALTY:¶
The remedies provided by this chapter are cumulative and in addition to any other remedies available at law or in equity.
A. Causing, permitting, aiding, abetting or concealing a violation of this chapter shall also constitute a violation of this chapter.
B. All violations of this chapter shall be misdemeanors.
C. Violations of this chapter are hereby declared to be public nuisances. (Ord. 2546 § 1, 2003)
